Warning: Germanautodismantlers

Just had to post this
Beware germanautdismantlers, Cleveland Ga.

This fender for a '73RS clone was advertised as a clean, rust free, 1 dent item and priced accordingly

Don't know if you can see it(middle left), but the one dent was a small crease along the upper portion of the fender

cancerous headlight bucket, bent light surround, signs of previous body work around the leading outer face, dent on leading inner face

cancerous lower leg

Since shipment they refuse to accept calls to remediate this

Nothing new for those guys. Several un-happy forum members have posted in the past. I purchased a (small) part from them and it was not-as-described. Never again.

Very unfortunate. It seems like going to Vegas with most of these used parts dealers - the house always wins!

Sorry Bill.

Very sad - pride in business transactions and customer service has almost totally gone away. I hope you paid with a credit card so that you can dispute the charge. Under most credit card agreements and under the Fair Credit Billing Act, you can dispute the bill if the item delivered was not what was ordered. In your case I think you have a winning claim!

In 22 years in the Air Force, we would get this complaint all the time. As the base JAG, here is the advice I always gave (direct from one of my handouts):

To dispute a billing error on your credit card, you must:

Write to the credit card issuer at the address for "billing inquiries," not the address for sending your payments (the address for billing inquiries is often found on the back of your most recent monthly statement); include your name, address, account number and a description of the billing error.

Send your letter so that it reaches the credit card issuer within 60 days after the first bill containing the error was mailed to you.

Send your letter by certified mail, return receipt requested, so you have proof of what the credit card issuer received. Include copies (not originals) of sales slips or other documents that support your position. * In your case, send copies of photos of the defective rusty fender as well as proof that the fender was "advertised as a clean, rust free." Keep a copy of your dispute letter.

It is important to send the letter to the correct company. In the case of Visa and MasterCard, you should send it to the bank that issued the card.

Under the Fair Credit Billing Act, the credit card issuer must acknowledge your complaint in writing within 30 days after receiving it, unless the problem has already been resolved. And the credit card issuer must resolve the dispute within two billing cycles (but not more than 90 days) after receiving your letter.

I hope this helps.

David

sorry to hear you were hit by them, Bill

you may be able to dispute the charge on a credit card if you used that mode of payment

this will likely continue until they are taken to task - that means either complaints to the Ga. Attorney General or a hired gun

First thing to do is send them either a fax (and save the printout that says they DID receive it) or a certified receipt USPS letter

never trust a phone call to an untrustworthy person...

Another thing I've done to cover my rear as a buyer is printing out the eBay/Craigslist ad so there can be no dispute later about how an item was advertised after the ad is deleted.

So far, I've never needed them.

Sorry to hear about this Bill. There have been numerous threads on this "company", which changed names at least once in the past 8 years. Formally known as "PAP".

Sorry to hear of your bad luck. I was just up in Cleveland this morning for a pick-up after ordering a 993 quarter. Joe and his crew went beyond the call to cut it off just as I asked. Try calling him again; he is a very reasonable man and I have never had issues with our dealings (and he's the only used parts source I've tapped for my current project, with the exception of the 3.4L engine that came from the ZH guys).

The word I have heard is that one of my local competitors here in Colorado recently flew out there and filed suit over a rebuilt transmission that he didn't pay them for.

He also owes us money over a similar deal where a rebuilt transmission was drop shipped directly to a customer and then we were mailed a check that bounced.

Do we have a sticky where we keep track of questionable vendors. Or, for that matter, vendors we really like and recommend? Kinda like an Angie's list for Pelican's?

The owner/mods of this board, for several good reasons, don't like to allow threads about the 'performance' of competing vendors.

I think the only reason this thread has been allowed to go on this long is because Wayne doesn't sell used front fenders.

I guess the fact that all of the rusted metal had been blasted away might make this technically "rust-free". However, it is really poor to advertise it as such. To make that fender usable you will need to weld in some metal. Not the end of the world perhaps, but certainly not what was advertised it would seem. Sounds like some pretty good advice here on how to dispute this though. Best of luck in getting a fair settlement.

Don't waste your time filing a complaint with the State Attorney General's Office in that state. Quite some time ago I bought a windshield from Henry "what's his name" who was an active seller on Ebay and familiar to quite a few here. When the windshield arrived at the shipper, I had them open it up to check it. It was totally smashed. I refused delivery, notified the seller who said he'd get another out immediately. Long story short, he didn't, didn't answer calls or emails, & wouldn't refund my money.
I filed a complaint w/ the SAG in his state. It went nowhere, and when I called them, I was told they are "only a mediator.'' I ended up getting an attorney in his city, spent the money to start a suit. He responded by getting an attorney to write me a letter. When my attorney talked to his and told him I was serious and going through with it, his attorney told the seller how much court was going to cost him and that he would lose, he refunded my money for the windshield.
Money well spent.

The value of filing a complaint with a State Attorney General's Office is not usually for you - except in the most egregious instances.

It is more of a public benefit; get that guy foff the street type thing after several complaints have been filed. If no one does anything then there will never be a record of abuse.
