I apologize for venting again but this does relate to vendors we all seem to cross while being p-car owners.
Please read me original post as well as the comments from many of you: **cked by PAP The update is that a couple of days later, Joe Cogbill agreed to give me a refund of my $1,00 after he had the ducktail picked up and verified that it did not have a metal frame.....guess what, he lied again. 2 weeks later after nobody picked the ducktail up I called and he said he screwed the input into the UPS software. A couple days later the ducktail finally gets picked up. The middle of December I get my credit card statement and no refund. So I call Joe again. Now he gives a story about me not being nice and the slow holiday season so it will have to be the first week of January. I call and leave him messages and nothing. I called last week, nothing. I called Wednesday and Thrusday, still haven't heard from him. Just got my credit card statement yesterday.....nothing. Now I have to start the process of calling every extension in his company and leaving messages. That is the only way he will return my calls. So, I am out $1,000 for 11 and 1/2 months with nothing to show but lot's of time on the phone. If you go to Hershey and meet Joe, ask him what's up and if he has called me back.

Buy a fax machine, load it with a blank piece of paper and set it to dial his # and extension...
Works wonders for getting people to call back ![]() Don't forget you can chargeback!

Can a local Pelcanite make a visit for Fritz? Perhaps if all paperwork is faxed over this can be brought to a successful conclusion. Worse case scenario: get the fiberglass unit back and sell it.

Ron's got a point. In the past when I have had difficulty like this, I have had no problem calling my CC and having them work it out. They take it off your statement and then THEY hassle the guy for an answer.

Here's what has worked effectively for me in the past - give them 3 choices:
1. Refund immediately (I'd skip this option, you've already asked for this) 2. Explain you will call your CC company, and they will arrange the refund 3. If that fails, explain you will be inviting them to join you in court (in YOUR jurisdiction, not theirs) and that lawyers are expensive. Due to the cost, this is not a small claims court matter, and YOUR legal expenses will be added to the fees. This typically convinces them they will be paying you back, and that they should choose the method which is most convenient (and less expensive) to them. -Boyo

It seems like there is always some other side to the story, but yours sure seems cut and dried.
You paid for the part, he took the part back, and he didn't refund your card. He's got your money and the part. The easiest way is to contest the charge on your credit card, which is also good because "chargebacks" look bad on the vendors account. Too many and they will lose the account. The problem is you only normally have 30 or 60 days to contest the charge with the CC company, and it seems that time has long past. Although, I think I'd still try it anyways, and explain you didn't contest it because of his continuing promises to refund you. The "chargeback" process is very consumer-oriented. Small claims court in your town is the way to go. There are limits but $1000 is well under the max. Force him to either come up and go to court with you in Colorado or he is in default. Then there is a judgement against him and the local LE in Atlanta will go to his place of business and either get the funds from him or start loading trucks with parts.
I just did an Ebay auction with him and no problems at all but have also heard of others who did not fare so well. Hope you get your money back. Joe

Brian is 100% right on the CC issue. regarding the court in "your" jurisdiction....it may not work that way. Each locality can set a limit for small claims...In my locality it is $2500. It would be very expensive if at all possible to have a hearing moved to the location of the purchaser.
I would think that the postal authorities (Postmaster General..Also Attorney General) would be very interested as cross-state law have been possibly violated. They would surely be interested in the proof that ebay feedback comments provide as backup. If a pattern is evident they may act. I still vote for the local Pelicanite making a friendly visit to straighten the matter out. Then chaulk it up to a lesson learned. Just my .02 cents. Good luck Rick

Joe is a crook. I have been burned by him in the past and will never go back. I know many others in the Atlanta PCA that feel the same. Sucks that you got bit. Hopefully others will figure out he is a crook and stay away.

I don't think filing a small claims suit is gonna scare him. To do that, he has to be notified by certified letter. If he's been in trouble before, he knows that no stranger is ever gonna send him good news via certified mail, and he'll just refuse to sign for it, which means your suit will go nowhere.
CC chargebacks actually sting. From my days of selling DSL for a fly-by-night place, I know they sure hated life when irate customers played the chargeback card. The CC company has access to the vendor's checking account and a chargeback will make the CC co. yank the funds from that vendor's checking account without even asking. Then they hold the money until it's resolved. This stuff adds up when you do high volume and it hurts.

Here are some other creative things you could do, but shouldn't.
![]() 1. Notify Porsche, Audi, and VW, and eBay that pap-parts.com is using the Porsche trademark (and artwork, for the eBay logo) without proper acknowledgement on their web page 2. Find some Porsche fan h@ck$rs looking for a joyride, pay them a few buck$ to have some fun with their web site 3. Ask PCA to refuse sponsorship by PAP, and ask them to ask PAP to remove the links from their page 4. Post a salacious ad on as many adult classified sites as possible, and list their phone number for contacts. Include pictures of cross dressers; have them ask for the owner by name... Etc. etc. etc... -Boyo
