Just to clarify, the BAC in California is
.08, not 0.8 and to answer your question, it's
not legal to drive at the lower lever.
In many states, including Ca., the BAC measure is the threshold that defines
absolute violation. However, you can be arrested and charged with DUI with a lower BAC if the officer determines you were impaired. Just because you test lower than the legal limit does not mean you were not driving unsafely or dangerously or you were not a danger to others. Any BAC below .08
is the sliding scale.
