Along this same theme, one of our fellow Porsche drivers was convicted a few days ago:

I realize how lucky I was when I was younger. Today? No booze...

"Kirby lost control of his car due to his unsafe speed ..."
Never mind the fact that his BAC was .13 two hours after the wreck. I get tired of speed being cited as the cause of every vehicle accident. Any reasonable report would conclude he lost control of his car because he was drunk on his azz.

While I agree no one should drink and drive. My issue is why it legal to drive at 0.79 but you are a criminal at 0.8 ???? Why not a sliding scale?

In many states, including Ca., the BAC measure is the threshold that defines absolute violation. However, you can be arrested and charged with DUI with a lower BAC if the officer determines you were impaired. Just because you test lower than the legal limit does not mean you were not driving unsafely or dangerously or you were not a danger to others. Any BAC below .08 is the sliding scale.

Hi
|
This is so sad. People dead and a young man going to prison for the better part of his life.
Even if he gets out after 25 years that'll put him at 49 y.o. The best years of his life spent in prison. And the family that has lost a loved one... you can never make that better.

That's true and sad that everyone concerned looses. I think the sentence was called for. My opinion is that anyone who drinks to the point of becoming impaired like that commits murder. The make the decision or allow them self to do it and drive afterwards. Plus, most of the people who do this kind of think are repeat offenders. There was a case in this area not too long ago where some guy who had been convicted of DUI numerous times, and finally ended up killing someone, got 18 months in jail and probation after that for something like 3 years. A ruling like that doesn't do justice at all for the damage inflicted.

BTW, unless you are a real lightweight who never drinks and can't hold his liquor, .08 is not much at all. Barely a bit of a buzz. Like 2 or 3 light beers. Not them fancy strong European ones, good ole 'merican light beers.

Unless you are a cretin who thinks that being a man means you should drive impaired, it doesn't matter what level of buzz you have.
It should matter that you respect others enough not to endanger them with infantile bravado. That is being a man.

My post was to remind people that just because they don't feel buzzed doesn't mean they are OK to drive. Now don't you have someone to surrender to or apologize to for being an arrogant egotistical pompous wimp? |

People who cannot enjoy temperance drinking should not drink at all. I wonder how much time he'll actually serve. I've had one Yuengling lager with a fish dinner tonight and that might be all I drink tonight.
Merry Christmas All!

I made a general comment that touches upon several posts on this thread. You really are not special at all. You are a prime example of an ignorant blowhard. Happy Winter Solstice to you.

It's funny how sober people are talking about drinking & driving & how NONE of us would ever do it.
As another poster said I was very lucky as a young man, different times, different laws. Oh... you can have 3 4 5 different felonies, what ever they may be and get F'ing probation.

But for the Grace of God, whatever that is, there go I, and I suspect a few others on this board.

I used to drive over to my BIL's house and have a few. Years ago, I started taking a taxi for $10 each way. At $20 for the RT, I could take the taxi something like 500 times for what a DUI would cost me. Did you know that if you have a DUI in the states they will turn you around at customs in Canada? I work in Canada as part of my job. Can't do my work, might not have my job.

If I get a DUI for walking, riding a bike, driving a boat I get fired. I have a company car. The suits call it behavior. So I also have to be 'good'.
