Landlord advice please....

What do ya do when yer dad is an "old softie" and simply won't enforce a basic agreement and unfortunately, I have to watch . I'm tempted to intervene for the first time ever....(I actually own the house)...and put an eviction notice on their door tomorrow...to send a message.

Have y'all ever evicted a cop and a lawyer

How long do I put up with this bs...it's been going on for years ......and now I'm pissed off....thanks for the opportunity to vent....

Dad actually reduced the rent on another tennant and is being suckered by the wife.
The hubby....(another disbarred lawyer) serving time for a while longer....

I am ready to totally demolish two houses...I just don't need to watch this bs much longer.

Oh yeah..my dad just doesn't "get it"...and it's now causing me to lose sleep. He's 83 and has been "slipping into darkness" for years...

I like to sleep well....

Judges will usually side with the tenant. Consider it a 3 month process. Wait for a court date, go to court and the judge will give them 30 days. Come back to court, same story and the judge will issue the writ.

Follow the letter of the law, hang the notice on the door, and file for eviction .
Run it like a business.
Im in this exact situation with my partner. He is the nicest guy in the world. He let a tenant not pay rent for over a year. She burnt us for over 6 k .
He has reduced rent on some other tenants, when they were struggling, and now does not want to re -up the rent . It is to the point , where they are taking advantage of us, and we are losing money
He has his buddy living in one of our places, and collecting rent is a night mare. He is next . I looked him in the eye last week, and told him that the bare minimum requirement to live in our houses, is to pay the rent. If you can't do that, you cant live here.
Landlording is a lot of work, and ..... it is a business. you have to put emotions aside, and run it as such, I have made all the mistakes , and learned my lessons the hard way
I would not be afraid to evict a cop and a lawyer. If they are taking advantage of my Dad or family , then fk them,. See you in court . There are laws and procedures for this .

We just got rid of that no pay tenant. As crappy as it felt while she was taking advantage of us, it feels 10x better throwing her dead beat arse out on the street. No more excuses, lies, and negotiations , g'day dead beat !

I could never deal with tenants. My hats off to you guys.

If those were my properties I would have a management company deal with the renters. I know it cuts the profit some. To be honest, it does not sound like you are doing much better on your own.

Dad is the problem...I'm in the middle, but I hold all the cards really.

Oh yeah.... the cop is an absolute racist...he doesn't like "ni**ers", beats his dogs, but my dad sees none of this....I'd have booted his azz years ago....seriously. I have no use for HIS lawyer wife either ...

We essentially lose money every single day (it's all relative) the tennants live there. I set this up 15 years ago to provide a nice income stream for my parents..that's been great, and my dad has always been in "charge". I suck at being a LL and my dad is even worse .

Rent hasn't been paid in full (or any amount)....as of today . Same as it's been for years....

I had a similar situation for a few months with a tenant. I "loaned" them the money for the rent. Wrote up a promissory note for 4 months rent. I figured if they didn't pay I could write it off as a bad debt. In the end, they paid with 8% interest.
I doesn't make sense to simply let someone not pay.

What do they say when you ask for the rent? You say they are a lawyer and a cop, are they employed? This is a strange situation. You have let it go too long, cut your losses and evict now.

It seems the longer you let the pig and shyster get away with slumlord abuse, the more difficult it will be to kick them to the curb, even if you begin to follow the letter of the law.

As far as not getting involved-it’s your house, not dad’s.

I try to avoid doing any business with lawyers, especially disbarred ones with cops for husbands.

I get angry just reading your posts about not collecting the full rent. These failing tenants take advantage of seniors, women and wussy landlords.

I have had eleven years of three different sets of tenants and the rent has been paid in full and on time in the form of post dated checks for the year lease term. As the above says go the full legal route to get rid of these deadbeats.

My daughter and son in law rent out their old condo. The latest excuse from the new tenants who own a coffee shop was "we had to buy some new coffee machines". They get the rent but it comes late every month and they have to bug them for it.

Get references from prospective tenants and be firm and fair.

Similar situation last fall, best thing I did was get the always-late tenants out. They were actually surprised that when the lease ended, we wouldn't extend or renew.

Make sure your new lease has a late payment penalty, and enforce it.

Tenants seem to always have a way to delay paying the rent.
Our new policy is 15 days late, =$75.00 late fee assessed .
30 days , starts the eviction process. No excuses .
I've got 20 years of excuses for not paying the rent under my belt. I've heard them all, and they all sound like BS to me . Once they go 30 days late, it will most likely be several more months before you get get paid, and odds are , they will never catch up.
By the time you evict, you will be out 3-6 months of rent, then have to clean up, and re rent. Pretty easy to lose a years worth of income if you don't stay on top of it .

immediately send certified notice that as of April 1, 2019 terms of the lease will be enforced.
Also get copy of the letter notarized and file at county courthouse.
Also send copy of the letter USPS.

Yes sir/No sir in all correspondence with them, text message, email and of course verbal.

Eat crow through february and march.
hire a lawyer for the eviction if the rent has not been paid by April 5th or whatever day the lease stipulates is the last day for payment.

Imperative to advise of notice to enforce the lease. Likely need 30 days notice of intent to enforce the lease. Window for March 1st is already closed.

How about this? Hire a professional property manager. Tell your Dad you need to remove emotion from this business and that you think a PM will do this.

I did this when I owned and managed. Had I done it earlier, I would have two or three million more today. Serious. It's a Long story.

I feel for you.

We had to evict 3 tenants in the last year.
Two cost us $1200 each (plus lawyer fees) to get rid of them. It is easier and cheaper to pay them off then to go thru a jury trial to evict.
The third cost $20k (relocation fee) to get rid of a long time tenant who was paying way under market value. The beauty of rent control. The LL is always the bad guy.
