Agent called me back to clarify something we discussed (as their office was closing no less)...I wasn't at a pooter. He emphasized that if it is not regulated by ATF that there would be no need to register it. But that even if it did you would only have to pay a $5 registration fee. He said if the agents were really that concerned about it, they would have been at your house within an hour or two.

These things rarely surface and ATF isn't really concerned about them too much...even those that have to be registered. "not too many gangbangers or terrorists interested in antique tear gas launchers"

Couple of other interesting things he mentioned:

Perfectly legal to own tear gas.

If it were rifled so that it could conceively propel a grenade it would be illegal.

You can even register a pipe bomb legally if you're so inclined.

He did a follow up call right as he was leaving his office but the office in DC/WVa was already closed (an hour ahead of us). He'll get back to me tomorrow with a definitive answer. If they show up before you get an answer, your recollection with grandpa was that it fired a low pressure 12 ga blank that has long since been NLA. It was obsolete long before he retired from the force. He used it as a paperweight.

This thing has piqued my interest...thru google I've found them selling in the $150-200 range with sellers stating "Not a gun...can ship to your home." Also found that lake erie chemical was a subsidiary of Smith and Wesson. The Tear Gas Billy Club as they were called were often used by prison guards and Police forces/Private Companies in the 1930's to quell riots and labor union uprisings. Kinda neat.

Yes Jim that is what I found too. All of the ones that are old and for sale use a .410 size shell and have a smaller opening in the front to just allow gas out. The others are aluminum or brass too. This one is steel and has a full bore which is what got me thinking "is it a gun". The rest of the thought process you know.

Just got a call from my ATF agent. Per his central office, since the shot shell propelled the tear gas cannister with hot gasses and did not have a projectile contained withing the shell, it is not regulated subject to the NFA as a firearm.

So there ya go...don't let them run over you when they come a callin'.

Well they contacted me today. They were very nice and said I was in no trouble that these things surface from time to time. he asked if he could come over and I said sure. I asked if he needed my address and he said he had it. I said that was odd because I didn't leave me address with anybody that I talked to. There was a pause and well actually we both laughed. As we figured here before when you call they know who you are. Anyway it was a pleasant enough conversation and he assured me several times I was in no trouble. We meet on friday I'll let ya'll know how it goes.
