What is this "superheated" coffee so many of you refer to, and how do I make some? Do I need a special machine to make "superheated" water like McDonalds?

According to the Wiki article, McDonalds (and others) still make their coffee the same temp as in that lawsuit. I.e., HOT, like coffee has always been served for the past 1200 years or so (1185 of which years were hot-coffee-lawsuit free!).

"McDonald's policy today is to serve coffee between 80–90 °C (176–194 °F),[22] relying on more sternly-worded warnings to avoid future liability, though it continues to face lawsuits over hot coffee."

So that lawsuit did in the end serve a public purpose. Hot coffee is unfortunately not made illegal. But now the warnings that were always on piping hot cups of coffee are MORE "sternly worded." Thank god for that.

Now they just need to stern up the warning on their Hot Apple Pie. "Caution - Filling is Hot!" just isn't stern enough for public safety. "Caution - Filling is Really, Really Hot!!!!" is so much stern and safer.

Its pretty much impossible to heat water past the boiling point (100c, 212f) at standard pressure (i.e. Coffee pot)

If we could eliminate this kind of chain e-mail crap and spam, I bet we'd cut down on the amount of Internet bandwidth used by about 50%.

It all really just comes down to "personal responsibility for your actions."

She made a decision to put hot coffee between her legs. She knew it was hot, and would have complained it was just warm. If she does not have a secure cup holder in her vehicle, she should get out of the car and go inside and drink coffee at a table. If she is so shot on time she can't go inside, don't stop for coffee in the first place.

Yesterday I borrowed Joeaksa's truck to do some moving and stopped at Krispy Kreme on the way home for coffee and fat pills. My wife went in and got it and brought it back out. That coffee was almost too hot to hold, even with the sleeve on the cup. So, instead of putting it between my legs, I (wait for it) put it IN THE CUPHOLDER!!!!!! I know, I know. I could have gotten rich in a BS lawsuit and put that miserable shop out of business for trying to make coffee stay fresh longer, thereby increasing their evil profits. But I just couldn't be bothered and besides, I like business that make products I'm willing to buy for a reasonable price. Call me crazy.

I remember being asked about that McD's lawsuit by people all over Germany when I went there right after that case had been decided. I was really ashamed.

I am sure it was big news in Germany, as rick stated, our ridiculous lawsuits get a lot of headlines over seas. I know this only because i talk to several furrners online and they often ask me about similar types of US news stories.

Judge Wompner has really helped

Change of the legal system would really help:
1.) looser pays all court costs, other party's lawyer and fees and awards ... helps to think twice if you want to really sue or not.
2.) have the lawyers filter cases before even getting off the ground -- ridiculous is just plain stupid!
3.) common sense might help

Add patent law to the list of revision too

I actually chatted with my divorce lawyer about this topic and had basically this to say,
Sonyland lawyers laugh at this all the time ... sure they could be making bigger bucks and they know it but will tend to tell you to grow up and not bother them about falling down a few steps in the middle of winter.

putting hot coffee between your legs has always been a bad idea.
Spilling hot coffee on your legs has ALWAYS been a bad idea and has always had the potential to result in burns.

IMO Mickey-D's did nothing wrong and should NOT have been the target for a stupid, greedy lawsuit.
It was her fault. All of it. 100% of it.
Getting burned was the direct result of her stupid actions and her lawyer should have been dis-barred. Neither one deserved any kind of reward.

This is the law in some states. The problem is that this lady WON. So, in addition to the jackpot justice, McD's would also be on the hook for her legal fees.

Yes, I did, and even though she is over the age of 80, she should be able to move out of a car seat in 90 seconds.

If she is so debilitated that she cannot move in a reasonable amount of time, then she should not be allowed to place hot coffee between her legs to put cream and sugar in. Sounds to me like her grandson should be brought up on reckless elder abuse charges...
