I live in a 25 home HOA, I was the Prez for 15 years. I gave up being the Prez last Summer. Now the new HOA Prez says I can't have my RV on my property because its against the CC&Rs (which is true) to store an RV on the driveway or street, and that I have to move it to another location (think $50+/month) with no security.
Being the past Prez of the HOA, I know the CC&R's very well, they have no legal mechanism to fine me for anything other than late payment penalties for dues. This HOA is pretty laid back, or was until the new Prez got elected, who I think is overall doing a fine job. I told her that I wasn't going to move my RV off my property. Most houses have a short, like 25 foot driveway, and I understand not parking boats, RVs, etc on the street in front of houses or taking up their short driveways. It makes the neighborhood look congested and trashy. However, I happen to have a 350 foot driveway and you can't even see the house from the street. She said "but people can see the RV when they walk up your driveway to go back into the "nature area", which happens to be my 18 acres of oak trees. I said that if it bothers people that much, I'll not allow anyone to wander up my driveway to walk through my Oak Tree backyard. She said I'm "not being a team player in beautification of the neighborhood". I said "I don't really care, people can walk up my driveway and enjoy my side area or not, but I'm not moving the RV. They don't like it, I'll put out an email to the HOA saying they can't walk up my driveway to enter my Oak forest (the average lot size is one acre, I happen to have 18 acres and about 1,000 acres of wild lands behind me). Here is a pic of my house from the street, and a picture of my house 2/3rds of the way up my driveway. If it totally affects people's sensibilities, I'll buy a camo cover for the front of the RV. ![]()

You've got to be kidding me. That woman doesn't have a functioning brain. Never mind that you can't see the RV, you're not parking it on the street or driveway anyway. She has no issue to raise with you.

That sucks, just send a email to all members of the HOA and tell them due to complaints of the RV by walkers up the driveway, your property is now a no trespassing area, unless the one complaining apologizes to you and the other members of the HOA. This will put the rest against them and the Prez. of the HOA for wrecking it for the rest of them.

When I was Prez, we were a pretty easy going HOA, a few homeowners would park their ski boats on their short driveways for the Summer since they used them most weekends. No one cared, we just didn't want their boats living on their driveways after the Summer boating season.
I'm not a big fan of HOA's but this one is generally very good. 25 homes, we all know what is in the best interest of the community, and no one living here really wants to eff up a nice neighborhood of houses that are, more or less, worth about $750K to $1 million each.

Send her a plat map of your land subdivided into 18 one acre lots. Add a simple note; "How do you like me now?"

I couldn't even see it at first. It's behind the gate right? Technically that is not in your driveway or on the street, which could be considered common areas. But I doubt the side of your house is common.
Unless the CCRs are amended to say ' no parking of RVs period", I don't think they can do anything. Especially because Motorcycles, Three wheelers, Quads, Jet Skis, Fishing Boats, etc. Can all be considered recreational vehicles. And people that have those won't want to move them off their property. Maybe you could just build your gate taller and hide the whole thing. Probably wouldn't look too bad. |

As you have already said, perhaps it's about time to withdraw permission to others due to harassment by visitors to your wilderness area (the complainer), and the legal liabilities involved.

OPEN VOTING HERE! my boss DID NOT VOTE for the board (were azzwholes to him and me in the past here)on this hoa. and that was made public and the hoa prez started his childish tantrum with us. swear to gawd about the initial firecracker settin all the napalm off. un bee- weeve- able poo!

The CC&R's say something loose like no RVs on any property. I'm just not going to respond. And you are absolutely right, 35 year old CC&R's. And they are weak with little if no enforcement ability. If the camo doesn't work, I'll erect a 12 foot fence to hide it better.

Give 'em hell Hugh! I quit asking permission of my HOA years ago for work I do on my property, they can kiss my ass. I've improved my home every year that I've lived there while they let my neighbor's house across the street fall apart. They are largely impotent organizations without the will or funding to legally challenge you. If they continue the harassment then shut down your land to public use, insure everyone in the neighborhood knows why, and tell the bored b!t@h that if she steps foot on your property that you'll press trespassing charges. I HATE homeowner's associations, my next house will be in the country where I don't have to worry about rude bored old people with a false sense of their own importance.

What is the purpose of the CC&R's?
To prevent mutually agreed undesirable behavior that negatively impacts quality of life and property values for resident members. In this case it's to prevent an eye sore which clearly does not apply your specific situation. I'm willing to bet if this got dragged into court or arbitration the HOA would be told to get a life and stop wasting everyone's time.
