Good luck with that. Don't kid yourself - the judge will not even listen to you. The cop is right. Unfortunately on traffic incidents, you are guilty until proven innocent.

1) Trial by written declaration
2) Trial de novo
3) If cop shows up at trial, go see him in person before and make a deal with him, plead "no contest" and ask for traffic school.

Next time just don't speed. I have never been pulled over going the speed limit, no matter what car. Yes, it is true, if you are in a minivan, you get away with more. That would be the alternative - get a minivan.

You will lose. It's not what you want to hear but sadly it's the truth. I had a similar situation once and the judge yelled "you drive a Porsche"! In the courtroom followed by laughter from the audience.
It was game over.

Don't shoot the messenger, But in California, if the officer has been trained in speed estimation. They can give you a speeding ticket without the use of a laser or radar based only on their speed estimation. If they have used one, They legally do not have to show you the laser, radar or the certifications at the traffic stop.

In Court, the officer would be required to show you his training certificates and certification of any equipment he used.

So you feel put upon, because that Wide Load travel trailer was frustrating you by hogging the road and possibly doing it illegally. AND YOU GET THE TICKET...HA

Unfortunately life is unfair..and it is really tough to have to chew on this one...it just make you twist inside or is it sieth ...but you got no place to go with it...you have to think about what your best next move is going to be?

I won. There were two of us (930, 911) in a caravan, I got popped since I was behind. Tricky speed limits and placements, but The cop pulled me over just a tad too late. I took a picture of the area where I was pulled over, with the two signs that said "End 55 Speed Limit", put some numbered arrows on it via photoshop, typed up a one page declaration (TBWD) - which I stated that wasn't it possible that the CHP officer that clocked my speed by pacing me, saw the number above the limit as he was speeding up to catch up to us.. I also stated that we were in a 65 MPH zone when he lit me up pointed out in the pic. I was "paced" at 70MPH, he wrote me for 68MPH in a 55 zone, which I contended was actually a 65 zone. Either way, I was above the limit and beat the ticket.

Ironically, we were coming back from an autocross.

The cop is lying. He didn't nail you with radar. You weren't going 94. He knows it, you know it. If he checked the "radar" box on the ticket, he can't "estimate" your speed.

My suggestion would be to have a conference with the prosecutor before you go in front of the judge. This one should not stick.

I once had a similar ticket from a crooked highway patrol cop who had a "special" radar unit that didn't set off detectors. They had "checked it thoroughly" and "couldn't explain it". He knew, as did I, that it was all a load of bull****. He nailed my brother a week later, in the same spot. The first thing out of his mouth when you got into the car with him while he wrote the ticket was "I bet you are wondering why your detector didn't go off". ***hole.

You won't win this one...the cops even gave you a "break" by knocking down the actual speed you were going.

The "myth" about cops giving tickets for quota's is that many cops during an 8-hour shift were simply cruising the streets ignoring what was going on around them...you and I know that 5-minutes into just about any day of driving, you'll see some meat-head doing something stupid on the road.

Besides recognizing patterns, the human eyes are excellent at detecting movement, even when someone is in camouflage, all some has do is move, and you can see that.

Try to go to traffic school, and put it behind you is your best bet.

I work Saturdays...

Hit the freeway at around 6-6:30AM...

Me and a handful of people on the 110 north doing 80...

I get lit up and pulled over... CHP officer was polite... I was polite. He claimed I was doing 90 but wrote me up for 80 "because over 80 gets expensive"

Don't know for sure if I was doing 90... I don't have cruse control and it was a stretch of open (no cars) highway so maybe my foot got heavy.

Did I get pulled over because I was in a sports car? Maybe.

Was I speeding? Definitely.

I mailed in the check.

Location: I-285 interstate, Dekalb County, Georgia
Time: 1630 hrs - rush hour
Posted Speed Limit: 55 mph
Clocked Speed: 80 mph (I was going with the flow!!)

Fine: $422.00

All sports car owners have similar stories. The pain of the fine aside, with online traffic schools like Cheap Fast and Fun costing $18.00 and taking all of maybe 45 minutes to complete, why make such a fuss of this ticket? They even send the completion certificate to the court electronically.

The time and energy it would take to fight this (and you'll lose) is not an efficient use of time. Make a cup of coffee, sit down at the computer, knock it out, and put it behind you. Be cautious for the next 18 months and reset the clock.

My friend's dad was the Brig. Gen of the USAF reserve base where the CHP heli is maintained. He got pulled over once and when he saw what was in the general's wallet the CHP officer stood at attention, saluted, and wished the general a safe and happy journey. True story. We never did find out what's in the wallet.

Reminds of an episode of "Highway Patrol".......guys does a pass on a truck at warp 9. Gets pulled over and whines to the Chip....I'd been following the guy for miles.

Chip asks do you drive this road often? there is an extra lane a mile ahead....

You didn't necessarily "Beat" the ticket. If you did a TBWD, you don't know if the cop responded to it....If the officer didn't respond, you could have simply written "I wasn't speeding" and you would have "beaten" the ticket.

Bull$!&^ ticketing doesn't go away unless we make it more costly for the system to handle. I would like to see ticketing and enforcement done from a safety perspective vs revenue-generation perspective.
