The title that BHCC has the lot as the previous title holder. This is the contention, that the lot operator “induced” me into thinking he would store the car until I could retrieve it. Instead, he claimed a lien and sold it.

That was my initial argument with BHCC, that I have a title in hand. They responded that they have a title with the lot/tow service.

The insurance company is the liable party to ‘make you whole’. Given that they have been informed and even inspected the car at the yard, I don’t see how it can be claimed as abandoned. What insurance do you have and which company is this ? It’s their responsibility to deal with the tow yard leeches.

Adverse possession of a vehicle that was wrecked like that is knowing full well the owner/driver was injured badly and then in turn the lot owner took advantage of a bad situation and made it worse

I have never known of an honest tow yard owner, operator. Think about what they do, all day. They steal your car under the guise of law enforcement. They choose that job because they are thieves, and operate like one.

I still cannot understand why the insurance company has not settled with you for the agreed value. Doesn’t make sense.

A few months back my wife had an accident with the non Porsche car that was towed. The very next day my insurance co. had the car towed to another facility so they had control. When I questioned they stated more important than storage costs was the control of the car, as very bad things happen to vehicles at tow lots. I now understand.
We all hope your issues are reasonably resolved, and you can move on.

You should never under any circumstances have your car towed to a tow yard. Have it towed back to your house, even if it costs. What is the point having it towed to a tow yard. You are NOT going to leave it there, put it in its parking spot at home and sort it out. You end up with full control and no time constraints to deal with anything. You are paying to have it towed anyway, don't pay to have it towed to their lot where they charge you, pay to have it towed to your house. The whole concept does not make sense to me. Tow yards are only for cars that are getting towed out of spots where they do not belong.

Very true. Maybe my judgement was a bit clouded after a concussion, a broken nose and a shattered patella. Perhaps instead of going to the hospital in an ambulance, I should have stuck around the crash site.

The last time I had my car towed after an accident, the tow yard crooks practically lied when they insisted the car had to be towed to their yard. I had to stand firm before they backed down. Most folks are not even aware of what their rights are about this scam type practice. In a stressful situation after a few hours of sorting things out and waiting around , people tend to be easy targets, understandably so.

Part of what you pay an insurance company those huge premiums for is to solve these types of problems. Although they'll never admit it--since insurance companies and their employees are the absolute lowest forms of human life--they have the obligation to sort it out, not you. Demand that they do the legwork. If they don't, file a complaint with your state's insurance commissioner. Report the tow yard operator to the consumer affairs division of your state's Attorney General's office. I bet he's got a track record. Keep the pressure up--don't give up, and don't surrender. You got screwed.

NEVER ignore the lien sale and never trust the tow yard. One thing the rest of us can learn is to always contest the lien sale even if the yard is acting nice and accommodating.

While I'm not even remotely qualified to offer you any legal advice I just want to say I'm glad you're okay. I saw your car for sale at BHCC and felt certain the outcome was probably not good.

So sorry to hear about your loss. Glad you're alive to tell your story. I am very confused though.

1. If you had insurance why were you not paid?
2. I understand that at the time of the crash you were injured and in shock and just went along with the car being towed to the lot. How long after the accident did you go to check on the car?
3. Where is the title of the car? How was it sold twice without a title signed over by you?
