There was an intriguing letter printed in Car and Driver, about avoiding points on your license. The trick goes like this: if the ticket is for $79, mail in $83. The court will then send you a refund for four dollars- do not cash this check. Points are only assessed after financial records are cleared, and since the state has it's money, they will never bother you about it again. This could be a load of crap, I don't know, but it sounds promising

For the last ten years, I have gone to court three times to fight my tickets. Lost all three in the trial courts, no matter what I said. I appealed each and every one, and won 2 out of 3 times. The judge makes all kinds of mistakes, many of them are not even judges, just temporary judges. Hear-say evidence is always a good one, lack of all required evidence is another, and you just have to ... be polite, shut up when they make a mistake, and appeal after you lose.
THe appeals courts are much more professional. THey actually follow the law. So, fight at every step. Bog down the courts, and one of us will win. Do not give in, do not pay the fine. Even if you lose, take comfort in knowing that the government has just paid $1000 for the judge to judge you, the clerk to tend to your case, the cop to testify against you, the building you were in, the electricity during you case, the DMV to worry about your points, and all they made is $200 from you. They lost $800. You WON. If we always fight our tickets, the system will come to a crawl and they will collapse from not being able to prosecute a speedy trial, and then we will all win. |
