That’s not the body language I would display if I were trying to get a job. Imagine what he might be like once he’s been hired a whole and not trying so hard.

The OP said this guy is a new hire and in training . At your company are new hires on a probation period ? If yes this guy has that time period to prove his worth or his flaws . Just like anyone else . Would I have hired him ? Nope . Is that based on his appearance ? Yes guilty as charged .

What did his background check look like ? Did he pass a drug test ? I am old school and don't get the mindset of looking like a human billboard , in my opinion that masks deeper issues . If/when you have to terminate I suggest you have security in the room . Good luck

I agree with your original post and this post. All I can really ad is proceed with caution your HR manager is going to be your problem based on that comment you said she stated.

I do not think there is anything illegal about not hiring gang memebrs or people with Tattos. That doesn't mean a suit could not be brought for desrimination. I recall a few suits in years past based on clothing, jewelry, hair styles and tattoos as they were considered part of "Ethnic Attire". I don't recall how they turned out though.

Contact your insurance agent and verify you have employment practices liability before you do anything.

Maybe you need to review requirements and standards for hires with the HR department.

At my place all hires are required:
take a drug test
pass a background check

The requirements get more specific for the type of work:
Factory hires:
safety glasses w/ side shields
steel toed shoes
ear protection
no dangling jewelry
Long sleeves
gloves
the list is quite long depending on the position


We have a controls engineer who wears long sleeve shirts because his has tattoos full length on both arms. A consistent policy helps and it needs to be enforced.

My former employer had a policy that tattoos were strictly forbidden for sales reps. All other employees had to keep them covered when dealing with the industry. I dealt with FDA and was strictly forbidden from having visible tats.

If so, maybe the company can pay for the removal and deduct said cost from his paycheck.

That was my 1st thought, he looks totally not interested, almost like he's been told he has to get a job

Not racist, your HR manager is, at a minimum, overly sensitive. What are the pre hire requirements? Pre hire drug tests are going away with mj becoming increasingly legal. I don't like them anyway. I'd rather see strict drug testing for any work related issue or impairment. Hiring has gotten tough with everyone expecting big bucks for flipping burgers or similar. A good background check will catch prior criminal offenses but that assumes someone was caught.

The number "13" indicates that he is/was a gang member affiliated with Southern California. The "13" correlates to the 13th letter in the alphabet (M) in which the street gang allies with the Mexican Mafia (eMe). Almost all of the Southern California Hispanic street gangs include the "13" as well as some of the Northern California street gangs.

The number "14" is the 14th letter in the alphabet (N) and indicates allegiance to the Nuestra Familia (NF), which is another Hispanic prison gang and bitter rival to the eMe.

It is strange, but there are some northern gangs that ally with the eMe, and there are some southern Hispanic gangs that ally with NF.

HR managers do like to flex their wokeness. - and dehumanize people as 'racist' to gain relative stature. (in their twisted woke-world)

Now maybe the poor soul was a bad little gangbanger and just got released from the big house. Part of his parole would be finding a job, so he can be a productive member of society. He might regret all the facial tats, but what is he going to do about it now ? The major thing to worry about is recidivism. How likely is it that he will go back to his old ways.
I would think that an HR person worth their salt, would be able to determine that by his conduct in the interview, his answers, and demeanor during said interview. He has made it to training, so he must have been good in his interview or he just got one over on your HR.
I don't know what to think. Either he got involved with the wrong crowd early on or he is pretty hardened.
Methinks this is in the boss's ball court.
