Kyle Guay v Sig Sauer - Sig Sauer Not Liable

I'm not sure how many of you followed this, or were even aware of it. One Kyle Guay attempted to sue Sig Sauer when his P320 "went off all on its own" and shot him in the leg. He had hired one Jeffrey Bagnell, a Connecticut attorney who has had a hard-on for Sig and their P320 for years. He's filed at least half a dozen lawsuits against Sig on this one pistol alone.

Well, Guay and Bagnell lost. They were unable to replicate the failure mode they claim is inherent in this design. Sig has, in the past, settled out of court in a number of other claims, but it appears they have finally had enough and fought this one pretty vigorously. And, to add emphasis, they are now suing Bagnell.

I guess I'm happy to see a manufacturer who is no longer willing to just cave because "it's cheaper" and, even better, go on the offensive. These kinds of cases have, historically, never been definitively "proven", at least to my knowledge. The Remington Model 700 case was probably one of the most widely publicized, but they seem to happen all the time. And, again (to my knowledge), not a single "accidental discharge" of the types alleged have ever been successfully replicated for a court. "Honest - I never touched the trigger, it just went off". And yet, even with the specific firearm alleged to have self-discharged, no one has ever been able to make that specific firearm do it again. That should be the a-number-one requirement to go forward in such a case, yet it has never been. Maybe with Sig's success, it might have to be going forward. Let's hope.

So wait, you mean to tell me that if there is operator error, the manufacturer isn't liable?
