Why are we still there?

We Must Pull Out:

Is it like Viet Nam? Should we really be there? Why are we there? Enough is enough.

It's time to reevaluate our involvement. Every day there are news reports about more deaths. Every night on TV there are photos of death and destruction. Why are we still there? We occupied this land, which we had to take by force, but it causes us nothing but trouble. Why are we still there? Many of our children go and never come back. Why are we still there? Their government has been unstable and, until recently, they have had sloppy leadership. Why are we still there? Many of their people are uncivilized. Why are we still there? The place is subject to natural disasters, which we are supposed to bail them out of. Why are we still there? There are more than 1000 religious sects which we do not understand. Why are we still there? We can't even secure the borders. Why are we still there? They are billions of dollars in debt and it will cost billions more to rebuild, which we can't afford. Why are we still there? It is becoming clear........................................we must pull out of California.

Maybe if we could get Bush to invade, he'd rebuild our infrastructure and institute national health care.

And by the way, in terms of photos of death and destruction, check out what happened in Colorado today...

And oh yeah, I don't think an Oregonian is in any position to criticize our sects. Didn't you guys have the Rajneesh?

This is completely an inside-lawyer joke, but it's one of the funniest apocryphal jokes I've ever heard. By way of backstory, California is in the 9th Circuit, the most activist, off-the-reservation, "we don't care what the law passed by the legislature says we're going to make it mean what we want it to mean" Circuit in the federal judiciary. Recently, they gave us the "strike 'one nation under God' from the Pledge of Allegiance" decision.

The Supreme Court of the United States has discretion to hear just about any case that is sent to it. There are a few matters of jurisdiction for which the Supremes are the court of first instance, which the Supremes automatically hear, but 96+ out of 100 times the Justices vote as to whether to hear an appeal from one of the Circuit Courts or not. The loser in Circuit Court files a Petition for Writ of Certiorari with the Supremes. If the Supremes decide to hear the case, they grant a Writ of Certiorari, meaning the Supreme Court is now seized of the matter and will decide the issue at hand, once and for all (in theory) and their decision will be the Law of the Land.

Anyhoo, Antonin Scalia is reputed to have drafted an opinion that begins: "This case comes to us on Writ of Certiorari from the 9th Circuit. Other reasons for reversal include..."

Sorry, it's totally a law nerd joke, but it's the funniest law nerd joke I've heard. And it's 2:15 AM after a night of carousing, so y'all have to suffer. TFB.

I'm a recent law school grad and con law is my favorite area. I was actually research to Ken Gormley when I was in school. He wrote "Conscience of A Nation", the biography of Archibald Cox, for which he was nominated for the Pulitzer Prize. He was research assistant to Cox.

But, I wanted to say that your explanation of present day jurisdiction in the Supreme Court was great. I've heard a lot of people struggle with that subject. I'll send them your explanation.
