I do not believe I’ve ever called out anyone on this board or any other as an “idiot”.

And yes I would close a deal on a man's word. A few years back I bought a Citation VII on a handshake and have closed numerous business deals in the same fashion. I guess it's an Old South type of tradition with me. Honor... at the end of the days it's really all any man has to call his own.

Thomas, it's getting hot in this chat room, and for that, I APOLOGIZE!

This can't be the first occurance of this problem in Virginia... How does one actually present something that doesn't exist for vehicles in their state that are older than 30 years?

Closing any deal on a hanshake and a man's word is fine when you are dealing with someone you know. In today's reality, and the number of charlatans on Ebay, I would never do it!

God Bless You, and the fact that you can successfully continue to do business that way in the south! Unfortunately on the Left Coast, there are far to many schemers and rip of artist's....

Patrick,

It's not too hot to have some fun!

This is all well placed banter and healthy debate over different views of a situation. No name calling, no threats to fly 2500 mile to open a big can of whoop A$$ - how's that for a big word?

All in all it's a very civil discussion.

Maybe I do have too much time on my hands... gotta go bill more hours.

Thanks Thomas, and Dave... I will now promise to put my shovel down! I've dug so deep. it's actually getting dark in here!

I apologize to any and all - especially Andrew - that I have offended!

This is such a bizzare and hard to believe situation with title. I thought California State Government was completely screwed up and mired in bureacracy. I should know, as I am a State Employee! I still have a hard time comprehending that any State would not issue title to cars over 30 years old.... Complete insanity!

You're absolutely right. I purchased a car out of Pompano Beach, FL and the dealer didn't have clear title on the car. I had to threaten a lawsuit to light a fire under their butts. My title arrived several days later.

The gentlemen I spoke with told me they had 60 days to get me a title. I informed him that I'd spoken with FL DMV and his tune changed really quickly. The title was delivered immediatley.

Mr. Zampardi and the Pelicanites,

After a night of "sleeping on it", I have come to realized that this whole ordeal was the result of unfortunate misunderstandings. The misunderstadings can be characterized on two levels, individual and business.

Perhaps, I can bear all the blames for the misunderstandings at the individual level. This has been a major source of problems for me and I have been working very hard in trying to rectify it. It is in my nature to treat individuals with courtesy, respect, and honor, even when I am at odds with them (I am sure that Mr. Zampardi can attest to that fact). I believe that, with time and patience, I can win their friendships and their respects will be returned. However, there have been many instances (this case, for example) where the individuals misunderstood who I am and took my nature as a sign of weakness, and I became victimized. And it is exactly how this whole ordeal got started, and I am very sorry for that. Had I been a little more forcefull, being an A--hole even, with dCAutomotive, for the past four months, I may already have the title in my possesion.

Perhaps I can also bear some blames for the misunderstanding at the business level that resulted from a few assumptions. My first assumption (and you know exactly what it got me) was that any terms and conditions in an Ebay auction constitute a valid and bonafide legal contract. My second assumption was that dCAutomotive was a reputable business outfit. They must have been because I've asked around to make sure that they are and many individuals have had fair dealings with them. So, when a reputable business promised me that they can get the NC title to me "if enough time is given" and we all now know that it's only two weeks, I honored their promise (see?, it took me back to the first misunderstanding). So now I know what my wrong assumptions can do to me, I won't be in a hurry to make the same mistakes again. And I urged those of you out there, who are like me, not to make the same mistakes (making wrong assumptions) like I have. Look carefully, at all transactions, with any individuals, online or in person. Huge lesson learned!!!!!.

My only interest here is to plead for the title, which it though should have be rightfully mine in the first place, from Mr. Zampardi and dCAutomotive. It was no interest of mine, it has never been, and it is not now, to say anything bad about Mr. Zampardi and his business. It is his business, including how he wants to handle it. I have no desire to see a court room. If I do, I would have been a law student, not a medical student as I am now. I would be gratefull if Mr. Zampardi and dCAutomotive business will provide me the title of the chassis I that I have paid for, on February 23, 2005. In the end, it's the title that I am after and when there is no foul, there will be no harm.

I apologize for any and all grammatical mistakes as I am writing this letter in haste.

Regards,
Andy

I don't think this qualify as an apology to DC Automotive or Mr. Zampardi .

It take a BIG man to say he sorry on this forum.

What in the world would he need to apologize for?

He was promised a title and 4 months later he doesn't have it. I'd be pissed, and very likely not as polite as Andy.

it's not an apology to you so you don't need to worry whether YOU perceive this apology as qualified or not

among the word "apology", Zampardi also wanted a retraction, which this appears to resemble

it's possible that they can meet somewhere half way on this error

Never give into the force Andy. I'd be hammering his butt until he was tired of the bleeding. Then again, I am somewhat evil to those who attempt to screw me. I never take it lying down. Apologize? I don't think so. How about forcing DC Auto to by the car back and pay your attorney's fees? It's called False advertising. And there are laws to protect people from it.

Andy,
Unfortunately, misunderstandings and miscommunication does occur; however, the response by the representative of dCAutomotive was totally unacceptable. There are other parts to this transaction that we, your self-appointed jury, are not privy to at this time but given the evidence it is quite clear to an injustice has been done to you. Although it is not realistic, dCAutomotive would have a much different view of this failed transaction should you have not paid them for four months...

I keep a directory bookmarked on my computer of places that deal in used Porsche parts and after reading the response from dCAutomotive I quickly realized that this is not a place that I would do business with and have since removed this dCAutomotive link. Their inability to carry through with the transaction has greatly hurt their reputation. I am sure that they will eventually hold up their end of the deal but, at least with part of this community, will never regain their previous position.

Who would have imagined that your 'seemingly' simple desire to make a purchase with dCAutomotive would have been such a nightmare? Where has customer service gone?...

The bottom line:

#1: Ebay listings are legal contracts. No further written agreements are necessary, outlining the terms of a sale. DC Automotive does cover themselves somewhat w/ the statement to the effect that a title can be produced "given enough time", or whatever it said...

#2: DC automotive has admitted that they dragged their feet on the title, but now that the dispute is out here in BBS land, they can produce one in 14 days if the buyer will fulfill some ridiculous terms. (Completely illegal, dumbest business person I have ever seen in my life).

#3: The guy who is babbling about states that did not issue titles at one time/for older cars is the BBS equivalent of running onto the playing field naked; completely irrelevent and ignorant. No state in the union will register/title a vehicle from another state w/o a title. California will issue a title on any car from CA. w/ a lost/missing/never existed title, but not from out of state. Other states vary, but in general, ebay involves interstate sales/commerce and anyone selling vehicles on ebay had better know the laws concerning ISC, lest they get a real legal edumication, in the form of an elephant dick.

If an old roller does not have a title, they should sell it locally, period. This is why they now need to bond the car; who knows WTF the story is on some phantom car that is 30+ years old??

Not true. I have been a licensed Florida auto dealer since 1990, and the state has done it for me several times, with no problems. Just recently did a 1976 Alfa Spyder from New Jersey, who only issues a registration for older cars.
