If the "friend" with the cantaloupe sized defect in his head were to die, resulting from the injuries received in the crash, could they then charge the little ba$tard with any other offense, such as vehicular homicide, or vehicular manslaughter? I wonder if it would constitute double jeopardy?

I'm no lawyer but I stayed in a HI Express last night.

If he were to die, I think they could go after him unless there was some ruling about that in the case already.

I don't know what he pled guilty to, but if it was a lesser included offense of vehicular manslaughter or homocide, then yes it would be double jeopardy.

The accident occurred on 8/26/o7. If the kid lives until 8/27/08, then the question is moot. Under the "Year and a day" rule, death must occur within a year of the original act to be charged for a crime resulting in death.
