The kid that killed my son never served a day. Driving on a restricted license had left the scene to avoid sobriety test. 6 months later involved in another accident while high, and he walked. No justice in this world.

44 arrested at the DUI checkpoint last night in the drinking area of town, Westport. How can people be so stupid?

estimated costs for a dui in KS and MO is about $20,000 over the next ten years.( fines, even if pled down, dui school expenses, SR22 high risk insurance. One of those states has a mandatory weekend included.

Is that Westport CT? I used to live there until 1976. There were probably 5 cops on duty back then. Was a great little town, but I'd probably not recognize it now.

I'm happy they got those drunks off the road. But sobriety checkpoints are a gross violation of the 4th Amendment and the SCOTUS even admitted it when they ruled that safe roads overrode our rights against unreasonable search and seizure. If I ever get stopped for one, I will be sure to waste a LOT of their time.

Maybe I'm reading this wrong but the kids were killed in a car where the driver was sober. They were doing the right thing and the drunk hit them.

I just hate it when cops do sneaky stuff to take drunks off the road, catch criminals, etc. If you are sober and without illegal items in the car then checkpoints shouldn't bother you. With no reflection on Rick or anyone else that has posed, it just seems that there are too many members of DAMM: Drunks Against Mad Mothers crying about rights these days. Have your life impacted by a drunk driver and then lets talk.

If the checkpoint becomes a fishing expedition for other information without reasonable suspicion then I would agree. The law does allow for an individual's rights to be curtailed for the greater good of society. Remember, you can't cry "movie" in a crowded fire! (yes I know I said it bass-ackwards)

I just hate it when the state is supposed to abide by the Constitution and only stop you once they have probable cause of a crime having been committed. Call me old fashioned.

Driving a vehicle on a public road is not a right but a privilege. Checkpoints are not for illegal search and seizure but to monitor the conditions of the drivers. We are not talking about searching private property.

You need to go read up on the SCOTUS ruling on this. Exercising a privilege does not waive one's rights, other than with regard to state implied consent laws. But we're not talking about refusing breathalyzers here. We're talking about unreasonable (aka without probable cause) detention by the state (aka police seizure of vehicle and freedom of movement).

If you are stopped for no reason and the cop just wants to try to get you to consent to a search of your car or say something incriminating, the worst rookie lawyer could get you off because you were stopped without PC. Police need a reason to detain citizens. And the reason has to be specific to each person or vehicle, not just keeping the streets safe for the general public. Do I really have to explain this?

No, he said it was unconstitutional, and if unconsitutional is okey dokey with you, it is not so much a concern of them going over the line, it is more a matter of erasing the line altogether.

You know, the irony is that when the SCOTUS ruled on sobriety checkpoints, they reversed a MI state supreme court ruling that they were unconstitutional. But the SCOTUS ruling left states free to ban sobriety checkpoints, which MI subsequently did. Pretty sad when a state has to pass a law to guarantee your rights because the SCOTUS refuses to do so in their decisions.

Well i say good for Michigan. I wish more states would follow suit. I've only seen them a couple times around Philly, and not in the last couple years. I have seen them in the Burbs more recently though.
