Pedestrian killed by distracted driver

Driver was messing with the radio and killed a pedestrian on a sidewalk, poor guy

Raleigh, N.C. — A Raleigh woman who hit and killed a man with her car while he was walking along a roadway Thursday afternoon was distracted by her car radio, police said Friday.

Princess Nicole Singletary, 26, of 2356 Derby Drive, is charged with misdemeanor death by motor vehicle after the wreck Thursday that killed Santos Cruz-Domingue, 61, of Raleigh.

Investigators said Cruz-Domingue was walking on the sidewalk in the 2100 block of Rock Quarry Road when Singletary lost control of her, side-swiped a utility pole before hitting him. He died at WakeMed.

Singletary is also charged with failure to maintain a lane of travel.

misdemeanor? this lady kills a guy because she is driving like a tool and she gets a misdemeanor? how about felony manslaughter....

there were a couple of cases (yes, two of them) here in utah where drunk drivers hit and killed cyclists. it took some serious action by the cycling community to get ANYTHING done about the drivers' responsible.

so, unfortunately, your statement has some merit. at least here in utah.

It was an accident, they happen and it sucks, especially in this case for Mr. Cruz-Dominque. People get distracted all the time including every one of us. You glance at the radio, or the cool car going the other direction for just a split second too long and wham.

The accident was just that, an accident. But I gotta believe someone's life is worth more than what a misdemeanor (which likely will be plead down) will result in -- 6 months & probation at worst.

One of the best lines I've ever heard was 'Justice is an occasional byproduct of the legal system.'

Great example:

These people never seem to get any sort of punishment, though:

Woman calls police over missing remote control

Associated Press

GREELEY, Colo. -- A Greeley woman called police after she couldn't find her television remote control.

Police showed up and helped her look for it. The woman found it in her kitchen drawer.

Police said the woman called on July 27 and told police she thought she'd been burglarized.

According to the Fort Collins Coloradoan the woman, who asked that she not be identified, said she doesn't like to misplace things.

It was criminal negligence! She should spend a year and a hospital that cares for accident victems. And several months in a real jail.

Agreed. The consequences of distracted driving are reasonably anticipated.

It ought to be more than a misdemeanor. She was driving and not paying attention to where she was going. That's not an accident, it's negligence. An accident is when something unexpected happens. What does any reasonable person expect will happen if you're driving down the road looking at the dashboard instead of where you're going?

I agree, the driver is fully responsible for the safety of the occupants and others while operating the vehicle.

Would be a misdemeanor if a 747 clipped a building while the pilot was fiddling with some switches?

these things are graded by the perp.s mental state

misdemeanor usually attaches to negligent behavior; felony manslaughter usually requires true reckless behavior
