After much deliberation with the wife-to-be, we decided to have a sit-down with the roommate and give her an opportunity to correct her behavior. Depending on how that conversation goes, we will break out the 'deals'. We also decided that we should probably look for a new place instead of give her an offer to leave. We need more space and I definitely need a garage, which this complex does not have (garages). If she gets her butt in gear and moves out before Nov, we will consider our options and move.

Monday I call and find out what the penalty for breaking our lease is. If our roommate decides to stay then obviously there won't be a penalty, she will just be on the hook for the full amount and we'll take our names off.

Brando,

If it were me, I would also have the paperwork ready to hand her for the separation if she "chooses not to be reasonable" so that you could give it one last try and if things do not feel good you can say "we tried, now its time to go!" and not have to do this a second time.

I would also send her by registered mail with return receipt a copy of the paperwork if you have to hand it to her so that you have official notice that she has been given a copy.

Approach her with the idea that you and your fiance are interested in having a three-way before you tie the knot and figured she'd be interested because she's not getting it regularly.

You'll either have a letter to write a different Forum, or she'll be looking for another apartment....

That kind of communication is a definite no, no. It's best to say nothing and walk around the house completely naked eating potato chips out of a bag. Do this every night and soon you'll be free.

This is one of the most mysterious things about CA to me. A friend lived there for a few years and has tons of nightmare roommate stories, and it's always "someone I knew from work" or "this guy I met in a bar." How the heck do people think living with a stranger is going to work?

Same here. I've visited a friend in Hermosa Bch. several times over the years, and she had some real winners. Not to mention the feeling of living in a college dorm with neighbors on top of you except if cost half-a-million for a college dorm suite...not for me. I've had roommates that I've given serious consideration to just burning the house down to be rid of them. It would have been less aggravating in the long run.

I found it was better to live like a pauper than have a nice place with a room mate.

I would like to leave this place without a TRO.

A bit of an update... Called the office, it's $1500 and 30-day notice to break the lease. Ouch. I was hoping for one month ($1385). Tonight I talk to the roommate. After looking through our paperwork we actually only paid $150 rental deposit. Refunding 1/3 of that to the roommie really won't give her enough to start looking for another place. I figured the options would go like this:

TERMINATION OF ROOMMATE(S) AGREEMENT

The terms of this agreement are legally binding and enforceable by a judge, commissioner or magistrate in the jurisdiction of ORANGE COUNTY, CALIFORNIA. The parties below hereby agree to the initialed and signed option and conditions below in reference to the property below. If the conditions of this agreement are broken, the damaged party may seek recourse through the court to recoup any losses to the full extent of the law.
PARTY 1: HER
PARTY 2: US
PROPERTY: APARTMENT
OPTION 1 [ | | ]
FIANCE & I will vacate the aforementioned property by OCTOBER 31, 2011 at the latest. Upon vacating the property FIANCE & I will:
• Remove all of their property,
• Leave their gate remote(s), front door key(s) and mailbox key(s) with HER,
• Remove their name(s) from the lease agreement (sign their name[s] off),
• Clean their room and bathroom, to original condition of moving in,
• Any remaining property may be disposed of.
Sign & Date: _________________________

OPTION 2 [ | | ]
HER will vacate the aforementioned property by OCTOBER 31, 2011 at the latest. In good faith of this agreement, FIANCE & I will waive HER’s liability of rent for the month of OCTOBER, 2011 (approx. $517.02). Upon vacating the property HER will:
• Remove all of their property,
• Leave their gate remote(s), front door key(s) and mailbox key(s) with FIANCE & I,
• Remove their name(s) from the lease agreement (sign their name[s] off),
• Clean their room and bathroom, to original condition of moving in,

OPTION 3 [ | | ]
HER and FIANCE & I will vacate the aforementioned property by OCTOBER 31, 2011 at the latest. Upon vacating the property HER and FIANCE & I will:

• Terminate the current lease agreement,
• Pay their share(s) of the early termination fee ($1,500): HER: $500, FIANCE & I: $1000,

Add language to include a move-out inspection and if it happens, conduct accordingly, photo-document and have everyone sign-off on the condition (whether good/acceptable, any deficiencies, etc.) This will help should any monetization of clean-up/repair be required.

Excellent advice! I made sure this was covered already in our lease documentation. Basically same condition (or better) when leaving as when we got there.

I bounced the document off our legal reference here at work, he says it'll get the job done, considering we didn't have an original 'roommate agreement' between the 3 of us when we moved in.

I was thinking something else entirely.

I was going to say that the mob used to dispose of bodies in Lake Tahoe. It is about a quarter mile deep, and the water at the bottom stays right around freezing. Weight the body, dump it and it will stay sunk, as the gas that forms as it decays to make it float does not form. Big lake, way deep, gone for good.

Maybe go with Joe Bob for a week.

That is better than my idea. I was thinking of naked Fridays, but idea is great. Maybe drinking milk out of the container too (while naked of course).

You are all a veritable peanut gallery

Had the 'discussion' with the roommate last night. It went relatively well as we both got to openly discuss what was going on. LubeMaster was pretty much on the money. She wasn't realizing how her behavior was being interpreted and apologized for that. I assured her, repeatedly, that we are willing to make an effort if she is. If things become a problem we can't just let them pile up until it gets to the point of "someone has to go". She agrees and we are both going to make an effort.

I was surprised at how well it went. WAY different than what I had expected.
