A neighbors tree falls in my yard. ...

Massive oak tree, easily3.5- 4 ft in diameter at the trunk. Took out a few smaller trees of ours( planted last summer) and a little landscaping, nothing major. We talked last night, and I told him that it was not really in my way, and that if takes a few weeks to clean up, I am cool with that. He asked for my help cleaning it up. I said "gladly, would you be willing to split the wood with me?" . He said " no, I want the wood" . I don't really like this neighbor, anyhow. Just two weeks ago, I GAVE him my old thule bike racks . When he asked about borrowing them, I let him use them for a week, and he commented on how nice it was to not have his bike in his hatch, and asked me if I would sell them. I don't use them, I thought it cheesy to sell to my neighbor, so I gave them to him.
There is easily enough wood for the both of us for two seasons, and he does not have any equipment. He has a little 12 " chain saw.. I have the saws, splitter, and dump truck to move all the wood.
Am I out of line to ask for half the wood? He seemed offended that I asked, but damn, this is gonna be a lot of work , and it will end up being all my equipment that gets it done. Seems fair to me that we both make out a little bit from this.

I just got really busy, sorry, can't help, oh, and BTW, having you on my property with power tools is an insurance liability, let me know what crew you hire and have them bring their insurance papers with them so I can inspect them before granting access.

Where I grew up in timber country, everybody who helps gets some wood.

I believe that legally if the tree fell on your property, you're clear to cut the tree at the fence line and then start restocking the wood pile with whatever's on your property. (You might want to check that, though.)

Here in Fl, whatever is on your side of the property line is yours - you deal with clean up (or your insurance co does), you can make tables, chairs, toothpicks or burn it.

What kind of neighbor says no to that offer ?
I could put in a damage claim to my insurance and have the city bill you for the clean up; or I could help you clean up your mess and it will only cost you half the wood.

Your neighbor sounds like an effing tool. I wouldn't have been able to NOT call back that night and say get this out of here now, I want my trees and sod replaced as they were before. I've got pictures, and I need the name of your insurance company..

And I think I'm a pretty nice guy!

With him being so generous, I'd sit back and watch him do it. Doesn't sound like is in your way much, so make him suffer, the longer it takes the better. I would not do anything else, never is a good idea to escalate things with the neighbors. Just in case however, I would take pictures of the damage (while he is not home) with the date stamp turned on. That way you can escalated it to your insurance if needed.

IIRC noise is pressure waves to move your ear drum, so if no one heard it, it didn't make a noise. Unless of course crickets and such heard it.

Put up a no trespassing sign at your property line. Tell your wife to put her bikini on. Have her serve you cold beers in a frosted glass. Chop that tree up in the middle of Saturday afternoon so he has to watch you. Own that neighbor Beyotch of yours.

Three choices:
1 He gets all the wood but has to pay for the all damages to your property.
2 He gets half, you get half the wood and he doesn't have to pay for damages.
3 It's in your yard so you get all the wood.
