Funny thing, I learned years ago that you do not refuse an order by a cop. Doing so usually results in bad juju... and in my day and age you did not get loads of money afterwards, more like days/weeks/months in jail.

Exactly. A cop asks you to do move along, you do it. These punk college kids are all wannabe lawyers that "know their rights". Again, i still feel the cops overeacted with the pepper spray.

Apparently spraying people with pepper spray is even more traumatic than being sprayed - the cop just got $38k in workers comp for his "suffering."

If I recall correctly, the cops told the protestors that they had to get off that sidewalk, and they said no. the cops told them that if they don't get off the sidewalk, they would get pepper-sprayed. the protestors said go ahead and spray us. One of them said please.

They wanted to get sprayed to make a statement. They got their wish. Now the stupidy of certain people rewarded these low-lifes with cash.

Why is it the dumbest people in the state are employed by the california university system and the 2nd dumbest attend?

That's pretty much it, the last person with any brains leaving california should shut off the lights on the way out.

This is the quad at UC Davis. Blocking a sidewalk has NO effect on foot traffic. The University and the police could have easily ignored the problem but they got all excited about putting on the riot gear. The average GPA of a kid admitted to UC Davis is 4.2. Bright kids protesting non-violently. The cops behaved like thugs.

There is a HUGE difference beteeen education and intelligence. HUGE.
They were acting stupidly.
They were involved in unlawful assembly.
They refused to move when asked to move.
They ASKED to get pepper-sprayed.
They said PLEASE pepper-spray us.

They got less than they deserved.

Assembly is not rendered "unlawful" simply because some authority claims it is. Don't be so eager to see us inch ever closer to the police state.

They had every right to be there. They were absolutely not harming a thing, nor even so much as inconveniencing anyone. They were completely non-violent. All they did was piss off some self-important bureaucratic lout who orderd their removal because he didn't like them. They now need to ferret out that weasel and do away with him. And everone else in the chain of command between him and this coward with the spray can.

Our Constitution is supposed to protect us from the whims of men like this. Included in those protections is the right to peacably assemble. Without first getting a permit to do so, by the way. Don't be so quick to wad it up and throw it away.

Not according to the California Supreme Court or the U.S. Dist. Court Judge who approved the settlement.

In California, for an assembly to be unlawful there has to be "a clear and present danger of imminent violence." 21 kids sitting peacefully on a university sidewalk isn't even close to unlawful assembly.

All that said, even if it were, the actions of the cops to disperse the "unlawful assembly" were not reasonably tailored to the "danger" posed by the assembly.

The cops could have ignored the protest. If they really needed to open the sidewalk, they could have ordered them to disperse and arrested anyone who didn't comply.

And while there might not automatically be a direct correlation between good grades and being wise, it strikes me that the protesters were proved to be the smarter ones in this encounter.
