I would install automated security. Your camera installations are great for reviewing after the fact but if this escalates you may benefit from Brinks/ADT sending the law out without requiring your call. A panic button is very useful.

Fencing the yard would be my second step including thick hedges.

Thirdly, I would recommend one keep a firearm in the house for a worst case scenario, self-defense. A pump action pistol grip where you can access quickly. I wouldn't advertise ownership as the grass killer does.

You seem to have a level head on your shoulders so I assume it goes without saying to continue with non-aggressive defensive measures to protect the safety of you and your family. Put my vote in for the document document document and report report report. He'll either correct, vacation in the clinker with bubba and/or cross the wrong person.

MRM 01-17-2014 01:32 PM

You did exactly the right thing. He would have escalated on you no matter what so it is important that you did what you can to protect yourself now. When I was a prosecutor I gave many people the advice to do exactly what you did and the only people who regretted it were the ones who did not follow my advice.

Now here is the absolutely most important thing you can do now. You must keep the trespass papers and a cell phone with you at all times and if you so much as see this guy, you MUST call 911 immediately. When the cops come you show then the trespass order.

You cannot in any way shape or form tolerate him pushing the boundaries of the trespass order. You must enforce it aggressively to the letter or he will continue to escalate and the cops will not back you up when you need them. They will not criticize you for aggressively enforcing the order. Arresting people for violating a no trespass/no contact order is one of the easiest and most satisfying things cops do. The charges always stick because the proof is in the arrest - a copy of the order is on file with the court so they don't need you as a cooperating witness to prove it at trial, and proof of the violation comes from him being arrested where you said he was. Every order for protection violation charge I prosecuted plead guilty. They all huffed and puffed and threatened trial and in the end when I asked them how they thought they could beat the charge they all plead guilty. And if he repeats, he will go to jail. He'll get some chances but eventually he will go away for a very long time.

I'd walk the dog on a leash for a while. If this nutjob tosses a piece of poisoned meat in your yard, your dog will find it and eat it before you know what's happening, if the dog has the freedom to roam.

Should something happen to the dog, I doubt Cash would be the one the neighbor has to worry about.

cashflyer 01-18-2014 07:37 AM

Rick knows my wife. If anything happens to the doggie, somehow that woman will find a way to build a nuclear weapon and turn this neighborhood to glass.

Rick V 01-18-2014 07:41 AM

She is just a tad feisty

I"m with her,, if anything happened to my dog , they would never find the neighbors body. he'd just disappear ....

cashflyer 01-24-2014 08:54 AM

Process server emailed me this screen-cap today, so I will call it "getting served".
Maybe I should call it, "Get off mah properteee!"

Baz 01-24-2014 09:13 AM

That's the neighbor?

He is missing an opportunity to portray a psycho in Hollywood...seriously.

stomachmonkey 01-24-2014 09:14 AM

Yeah that's got crazy written all over it.

MT930 01-24-2014 09:24 AM

He looks like zippy the pin head.

Sorry for your troubles, the fact this guy is operating aircraft is very disturbing.

BlueSkyJaunte 01-24-2014 09:29 AM

All this time I was picturing some grizzled old git with a crazy eye. Not some pencil-necked geek who shaves his head to hide his premature baldness.

My first thought.

Hey, there's nothing wrong with that! As soon as I started going thin, I shaved it all off. Would much rather have a chrome dome than a hideous combover.

Makes for cheap haircuts too. 5 minutes weekly with a Wahl electric razor buzz and I'm good as new.:)

gacook 01-24-2014 10:18 AM

Nah. What hair I do have is still quite thick and grows fast as hell. I shave daily. And blades are expensive these days!

I go buzzed because I'm lazy. Plus I'm not sure if shiny becomes me.

Thank god I still have a full head of hair, because when I had my head shaved many years ago for the military, my dome looked like the Sea of Tranquility with moles.

I was second in the "Ugliest Dome" voting. The guy who won looked like a patch of driving range turf after I practiced hitting ballls with a wedge.

My only option would be the Trump 360 comb over.

BTW, the pic of your neighbor has a very odd feel.

LOL, nice description! I was lucky enough to be "blessed" with a good head for shaving. But damn, I miss my beautiful, dark red (almost brown) locks! I look at my son, and he has the same hairline as I do (unfortunately). He likes to keep his head buzzed, I assume to look like dad, but part of me wants to tell him to enjoy having hair while he still can!

BlueSkyJaunte 01-24-2014 11:28 AM

I shave my head about every two weeks (periodically leave in a nice Mohawk), but only because my hairline appears to be growing downwards towards my eyebrows. And I seem to have been "blessed" with Brillo instead of hair.

HardDrive 01-24-2014 11:40 AM

Looks like a nut case.

masraum 01-24-2014 12:18 PM

looks pretty crazy to me.

I assume that's a pic of the guy standing inside your yard next to your house or something?

The process server took the short video. That is the neighbor, in front of his house.

He was working in the yard when the servers showed up. I don't know if their vehicle has a company name or logos or what, but from the very start of the video you can hear him shouting "get off my property. Hey, get off my property right now." etc.

This server left, and the company had to send a second guy out to actually make good service.

The following day the neighbor's wife called the HOA secretary and claimed that the servers had been very hostile and threatening, and that her husband felt concerned for his safety when they showed up.

The service company showed me the video so that I could see what actually happened, and to let me know they would keep it in case they were ever called to testify as to the actions that day.

GWN7 01-24-2014 06:09 PM

Has the HOA secretary seen the video? You might want to make it and a copy of the letter he sent available to the HOA so they know the neibour is full of (stuff).

A cover letter to document their behavior for the HOA too. Something like "After receiving a threating letter dated xyzc (enclosed) from Mr. A. Hole (which my video surveillance of my property does not support) I received legal advice from the police and Judge So&so that Mr. & Mrs. A. Hole should be served. The process server had to send two different servers because of Mr. A. Hole's aggressive attitude which they documented in the enclosed video. Mrs. Holes claim that the servers were threating is not supported by the video and both process servers will testify to Mr. Holes aggressive nature if needed.

A letter of this nature has been written and filed with the HOA.

This has been discussed with the HOA via emails.

330 01-26-2014 06:05 PM

Why not just beat him senseless?

Tobra 01-26-2014 08:25 PM

How do you do that to someone that starts out senseless?

grendiers 01-26-2014 08:39 PM

My god, rich people after rich people, when will it end?

'Is Bob smart enough to know what a burning cross on his front lawn means?'

Hmmmm, is that a typical rich person's response to trouble?

OK, so tell us how the Hatfields and the McCoys worked it out. That story always ends well... Revenge begets counter revenge.

The premise is that the neighbor is nuts. I'm thinking that this is true. Nobody sends out a letter stating that it is now OK to shoot your dog. It doesn't demonstrate a good logic process.

cashflyer 01-27-2014 05:24 AM

I'm far from rich, but I don't want to lose what I do have over a lawsuit or jail.

Because Bob sent his initial rant letter to the HOA, the HOA sent out a community letter this past week that everyone received on Friday and Saturday. It laid out Bob's recent complaints and stated what the HOA position is on each issue. Basically, it was so that everyone in the community would know what is going on and be watchful.

I think Bob is his own worst enemy with regards to the stuff he wrote in his letter.

javadog 01-27-2014 05:25 AM

What did the HOA have to say?

JR

cashflyer 02-05-2014 01:47 PM

You all knew it was going to come to this....

Are there any attorney's in the house who specialize in batschiess crazy neighbor issues? If so, and you feel like hearing me whine and then giving me some advice, please PM me.

Thanks.

recycled sixtie 02-05-2014 01:57 PM

You could try a different approach and ask him out for coffee at a coffee shop. Sometimes being really nice works. Try it. You have nothing to lose.:)
G.
ps. He might even break down and cry and say I have found somebody that listens to me. Or am I being naive?!!

Well, some of us had hoped he would spontaneously combust but I suspect he's still around. Since many of us do not watch reality TV and come here instead for our daily entertainment, can you provide any details of the next installment of this saga? It's one of the better threads going.
