Dick move or not?
 
I am looking for an older amb transponder for Karting. I posted a wanted ad on the local Kart club's online classifieds (I am a member).

Yesterday morning a guy replied with his phone number. I called him 40 minutes later. It was 7:00 AM (his time when I called) and someone else already scooped it.

If he posted his transponder for sale in its own ad and not replied to my wanted ad then for sure, first to reply gets it.

What do you guys think? Should I be mad?

If I was him I would have replied to my ad asking to be next in line.

I think the call on the field is no dick move, because you didn't respond first.

On appeal, the call will be reviewed in super slo mo.

Appeal to the FIA. They will rule that your move was just a racing incident.

Then two weeks later they will ban you for a race.

Why would he wait to hear from you if someone came along and said they wanted it? Him responding to you is not you responding to him.

Think about it.

You post a for sale ad for your car. Someone posts a wanted ad for a car just like yours. You call the guy and leave a message. Some other guy calls you up with cash in hand to buy your car. What are you going to do? Turn down the cash in hand offer because you called the guy with the car wanted ad? Not bloody likely!!

Not a dick move. You asked for his phone number - you didn't commit to buying. Someone else did.

Now if you had a verbal DEAL and he sold it. Thats a dick move.

I did not ask for the number. He replied to my ad with his number asking me to call which I did 40 minutes later.

You can be mad, and worry about whether or not it was a dick move, or you can let it go.
Either way, someone else got the transponder.

Agreed.

I'm the guy who helps out everyone at the track. Maybe I be more selective from this point on... I know who scooped it and it's a small club.

Isn't that always the case. You try and be the stand up guy and put the big picture ahead of needs of the individual (or the self) and the ONE TIME you'd like something to work in your favor, you're made to feel bad about the whole thing.

A dick move is if they agree to sell you the item, THEN sell it to someone else.

Dick move. You created the opportunity for the seller to offer you what you wanted. The dick cut in line to grab it out from under you. The dick didn't post a wanted ad that generated the opportunity, you did. The buyer is a dishonorable dick.

Can/would the seller cancel the sale to the dick buyer?

Again, no dick move here. At least not the way it was described.

Okay. I always go back to "Money on the wood makes the deal good."

From the sellers perspective though - you're just another schlub asking... I stopped selling things to private individuals for the most part because of hte 99% of tire kickers and the 'as soon as I sell X I'll have your money' guys.

Not saying you're that guy - but how would he know.
