OK - I'm tired of seeing this in EBay ads. Are there any Contract Lawyers on this BBS? The one thing that I remember from by business law is that in order for a contract to be binding, there needs to be an Offer, Acceptance and >>>Compensation <<<. This often is accepted as a down payment. If any of those three conditions are missing, then there is no contract. Did I miss something or was my professor wrong???

You need offer, acceptance and consideration.

The e-Bay ad is the offer. The winning bid is the acceptance. The consideration from the seller is the body kit and from the buyer is the $$. So there could be a binding contract (i.e. all the elements may be present).

Just because the consideration has not yet been exchanged does not mean that a contract has not been formed. Most lawsuits on contracts are to compel the delivery of the consideration.

An example of no consideration would be this: You offer to pay me $5000. I accept. We sign a contract, its only term is that you will pay me $5000. That contract would fail for lack of consideration.

Why does this remind me of the Fiero converted to look like a Testarossa? It is the spitting image! (Right) I am having a hell of a time figuring out if there are even headlights on the car. I don't know who the target market is, but I would assume it is someone who has a Porsche that is rusting out and cannot afford to fix it the right way?

Additionally, how exactly would it make sense that the value of the car would go up when it no longer looks like the car it is supposed to be? From the pictures I do not even see the signature hood ornament. Maybe he should develop the technology to convert a Chevy Cavalier to a Porsche or something along those lines.

I think my favorite fact is that this wonderful opportunity is the result of his having a kit he is not going to use. I wonder if that is because he doesn't actually have a Porsche to use it on, or if he knows this is a goofy idea? Maybe he should try to set up a conversion shop. At least then I would understand that he was going to be reselling the parts he took off from the cars. This plan has several holes.
