One of the houses I lived in had covenants but no HOA. The developer created covenants to make sure all of the houses looked a certain way, then simply did not ever start an HOA. Once the developer was gone, there was no enforcement mechanism for the covenants, so they are effectively moot.
Years ago, my parents bought the 7th lot in a 400+ lot subdivision. The developer didn't get around to founding an HOA until about 50 houses were built. My parents refused to join the HOA, pay dues, or follow the covenants. The HOA filed liens and tried to collect past dues and fines (as my dad put a satellite dish on the house which violated the covenants) when they sold the house, but their real estate attorney got them out of it as joining the HOA was not part of their purchase agreement (and didn't exist at the time of their purchase).

I’ve never had an issue with an HOA until this year. The HOA bills are sent out in Nov and to be paid in Jan. Well, we never got one last year and didn’t think about it until we got a letter from a lawyer saying there was a lien on our house for not paying it. I was not a happy camper.
Turns out the new HOA rep was sending it to our old house and not the house we lived in for 3 years. They had our address, email and phone number, but couldn’t contact us. BUT the lawyer was able to send the lien right to our house. After getting nowhere with the HOA, we paid the yearly fee and $500 in late fees. We still don’t have the lien released after 30 days. We’ve still not received this years HOA fees invoice... |

We have a great HOA. In fact we are having a meeting and Christmas party next week.
We had a problem at one house where the single mother home owner got a new boyfriend. She moved in with him, and turned her house into a rental. Five single guys moved into a house with three bedrooms. Each one had a car or pickup. The three car garage was full of crap, so they all parked on the street every night. Regularly parking on the street is not allowed, and it is a single family home, so 5 adults are not allowed. We sent them a letter. The boyfriend went nuts and threatened lots of problems. We paid a lawyer to send a very specific letter on the next steps we would take with the force of law on our side. The 5 single guys moved out, a nice family moved in, and all is back to love and harmony. We can only surmise the boyfriend was told to back off.
