on a serious note Dueller why isn't it common practice for atty's to file two lawsuits; one for the atty and one for the client? the issue of course being that the client gets to put the entire award on their tax return and the payment to the atty (say 1/3) gets put on the sch. a which gets phased out once dollars get big.

Not sure I follow you, Beretta. I guess my "legalese" answer would be that atty has no standing to sue the tortfeasor. In other words in the GGW case, scumbag filmmaker didn't do anything to the atty. The atty is only present to represent as an advocate for the victim.

Anyways, tax law was my worst subject in law school. So bad that I promised my tax professor I would never give tax advice if she would let me out of the class with a :C". She did and I don't.

Hmm...you would do quite well advising DC politicians (either party) considering. Heck, going back on your word is a bonus and would only make ya fit right in . BTW, when I was 16, and looked EVERY bit of 16, I obtained an official state ID card showing I was 18 but with a different name (went down to the HP office with an older friend's birth cert)...no way in hell should someone else have been held accountable for my "underage activities" back then imo.

Ok, KC. I understand your point. BUT, where would you draw the line? A precocious 13 y.o.(and they are out here)? Public policy dictates that at some point an adult cannot do certain things to/with a minor. For that matter, there are certain things adults cannot do to each other.

Should she be able to recover for her loss of privacy and humiliation? Assume she had a resonable expectation of privacy.

I think what triggered the "doesn't matter if she was 17" response, was the "windfall" she (and her attorney's) we're seeking after the fact due to "damages". Should there be severe penalties for scumbags like Joe Francis...probably. Should the "victim" (and I use the term VERY loosely in this case) and her attys. make a small fortunes for "HER" actions...I dunno.

Das...I spent my college years spring breakiing in Ft. Lauderdale many years ago. LOTS of drunken debauchery went on, but I'm glad there weren't cameras rolling, and I'm not female. He exploits drunk college girls for the most part...I have a problem with that. These aren't "pros" he's using, but inebriated party girls who get caught up in the moment. I'm no more envious of Joe Francis than I am of high rolling drug dealers...they use people for $, nothing more imo.

While I was out in tyhe garage I thought about that very thing, KC. And we got off into criminal actions versus civil actions and kinda mixed these two very different aspects of the law. Like I said, I wasn't the lawyer...I represented this girls mom in a divorce. And I don't really know if it was a settlement or a judgment or a settlement for a lesser amount of the judgment. I suspect part of it may be to cover ounitive damages to punish the guy for his actions and to prevent others from following his road to riches.

Ehh...I have to disagree on the "exploit" part. There are TONS of girls/women out there who would flash their biznoobies without hesitation (or renumeration) for a shot at their 15 minutes of fame (had a girl in my boat, with a perfect set of big C's, flash a guy on a bridge in exchange for a cigarette once). On the other side of the coin is my current g/f who has a nice bod, but dresses like a nun. I couldn't get her to show skin/cleavage regardless how much I paid (or boozed) her.
