This isn't any different than someone walking down the sidewalk who trips off of a curb, or walks out into traffic and gets hit. You have to be aware of your surroundings at all times to ensure your well being. You shouldn't have left a treadmill running (how do you even do that safely?), and she should have put her damn cell phone down long enough to see what she was doing.

Creating a situation that causes a reasonable person to be injured is exactly why they have tort law.
Sometimes things are someone else's fault….think about a guy running a stop sign and T boning you.
Don't you expect that others will stop at a stop sign?
Is it YOUR fault some idiot ran the stop sign ?
Would you suck it up and pay for your damages and hospital expense ?

Walking away from a running treadmill is reckless, and the OP might be laughing, but should consider himself fortunate that no real injury occurred…this time.
Keep in mind that getting off a moving treadmill is a deliberate action, requiring forethought and coordination…just like driving.

Keep in mind that getting onto a moving treadmill is a deliberate action, requiring forethought and coordination…just like driving.

Obviously waking away from a running treadmill is a bad idea, but to get "worthy of a lawsuit" out of this is just a demonstration of how overly litigious our society is. That lady should feel like a dumb ass for stepping on a running machine....Sure she has a right to think the OP is a knob for leaving it running but why in the world would this escalate to involve the law? I know it has not, I am responding to zig stating that this is suit worthy.
People should be a lot more responsible for their own actions and look less to others to find fault.
This is nothing like running a stop sign, I am not sure how that comparison even comes into play....In that case someone did something unlawful, here they did something not too bright...

Without making this political, I find it interesting that entitlecat continues the trend of no personal responsibility. It is everyone else's problem and fault. Clearly this woman is an idiot and responsible for her actions.

The OP's
Would you be so forgiving if someone runs a red light, or a stop sign and causes you injury and damage ?
Aren't your expectations that the other person will obey the laws and operate the auto as per the rules of the road ?

Google Treadmill incidents and you will see where the fault lies.

And if you belong to a gym, ask the manager who is right and who is wrong.
If you know a lawyer...ask them, or call your insurance company and see who is going to pay in cases like these…where someones negligence causes injury to someone else.

Or, listen to the internet experts and see how that works out for you.

I don't see anyone arguing how the law would see it, just some people with a shred of intelligence left who lament the fact it could become a legal issue at all.
Zig the driving analogy is so far off the mark I can't even begin to understand your correlation.
This woman actively stepped on a running treadmill....and that is her fault under any sensible logic. Leaving it running not too bright for sure, stepping on it without looking is downright stupid.

The machines are taking over. First a treadmill injury and now a maniacal robot has gone berserk in another thread killing someone.

I'm glad my 73 911 does't have a computer on board. Its my only safe sanctuary...

In my 30+ yrs of going to the gym, I've yet to see a treadmill that you could not tell that it was running.

Lot's of opinions out there if you google "leaving treadmill running in gym."
Haven't found one yet that sees the OP as anything but iresponsible and a danger to others.

Here's one.
Plenty, plenty more.


That said, I really think you should interrupt your workout to find a staff member the next time you see it happen. Yes, it's annoying. However, the potential consequences of someone stepping onto the machine without noticing that it's on at a good clip (or accidentally stepping on the belt while trying to turn it off) are dire enough that a two-minute interruption in a workout pales in comparison. It isn't just a matter of possible treadmill burns; someone could wind up breaking a bone or getting a concussion. You don't even have to "catch him in the act" with the staff. You could just hop off your machine when you are in a recovery period, grab someone and point out the offender, then hop back on for your next sprint. You could snap a photo with your phone so you can show the person at the front desk who you are talking about.

Either this guy is really oblivious and doesn't understand how to stop the treadmill (which means he is putting himself at risk by using the equipment) or he's doing it on purpose (which means that at best he is a clueless prankster, at worst a booby-trapper). Whatever the case may be, this guy is actively endangering others and someone needs to stop it. He might be able to ignore you, but it would be tough for him to ignore the employee who has the power to kick him out of the gym indefinitely. I really do think that the "don't leave the treadmill running" message should come from someone with authority.
