Here in Washington, all sales are now subject to background checks, even private sales. That means going through an FFL and having them run NICS. No exceptions.
Check your state laws. A car forum is a poor place to seek advice on something that can potentially cause you a great deal of legal trouble. A simple google search should avail you of all you need to know.

In AZ you have no obligation to verify a buyer's eligibility. If you know they're a minor or a felon or a non-AZ resident, that's a problem. But we have a pretty common local custom of flashing an AZ DL and CCW and that's it. I won't sign a bill of sale. No need to make it possible for the state to know more than they need to know. Not my problem if a former gun of mine ends up in a crime scene. I don't want it to happen, but a bill of sale won't prevent it. And, absent any other evidence of my involvement, they can't pin anything on me. I don't even have to talk to the police if they ask me about it, and I would not.

I just sold a Henry .44 Big Boy to Cabela's. Did I get the 'street' value? No. Did I walk in, and walk out 45 minutes later with cash in hand, no muss, no fuss? Yes.
Would absolutely do it again. |

How so? The only way one would potentially be in any hot water from the private-party sale of a firearm (in states where still legal) would be by KNOWINGLY selling to a prohibited possessor, which would require some sort of inculpatory evidence to have any teeth for prosecution. There is also no federal statute preventing/limiting private party sales. If you are worried, just request to see the buyer's resident ID/DL, and simply ask them: "You're not prohibited from possessing this firearm in any way, correct? Done. |

You can sell to anyone anywhere. Ship from an FFL to an FFL and all is good. It's up to the buyer to purchase firearms that are legal to own.
