1st of all, if they have been together for 13 years, and have a child, they are married. Common law is married. Just wait until they split up, and you will be finding them in court getting a divorce.

2nd, why is she witholding sex? What does he look like? Is is related to the child? What kind of work do they each do?

3rd, he is weak. He is human. A strong person would have left first.

4th, he is stupid. A smart person wouldn't been caught. How was he caught?

Common law is not common any longer (quite rare) and veries state by state. If they are in PA....like fastfred, it was abolished...and is only if the marriage started before 2005. Even then, the requirements are quite rigid. Marriage would have to be established by present intent...essentially exchanging vows of marriage. Since that is somewhat "he-said, she-said," other evidence such as representing themselves as man and wife, etc would be helpful to the case but not necessary. Child support is something different entirely.

We had friends in Western Massachusetts, that fully represented themselves are married. She even used his last name at times. They were "hippies", unreformed, in the 1990s. I seem to remember them having 4 kids.

He was a chimney sweep, and general, "whatever". She was basically a homemaker, but ended up working at one of the local schools as an aide. They rented out the house in the summer as a B&B, (not to be believed that anyone would rent the house...), and they lived in the barn in the back! They were never hungry, but were certainly on the poor end of the scale.

He inherited a serious chunk of cash, something like $850K. He ran. Moved to Florida without even saying goodbye. She sued to get childsupport as a minimum and to try to get 1/2 of everything.

In a handful of states (listed below), heterosexual couples can become legally married without a license or ceremony. This type of marriage is called a common law marriage. Contrary to popular belief, a common law marriage is not created when two people simply live together for a certain number of years. In order to have a valid common law marriage, the couple must do all of the following:

1) live together for a significant period of time (not defined in any state)
2) hold themselves out as a married couple -- typically this means using the same last name, referring to the other as "my husband" or "my wife," and filing a joint tax return, and
3) intend to be married.

When a common law marriage exists, the spouses receive the same legal treatment given to formally married couples, including the requirement that they go through a legal divorce to end the marriage.

Common law marriage is recognized only in the following states:

Alabama
Colorado
District of Columbia
Georgia (if created before 1/1/97)
Idaho (if created before 1/1/96)
Iowa
Kansas
Montana
New Hampshire (for inheritance purposes only)
Ohio (if created before 10/10/91)
Oklahoma
Pennsylvania (if created before 1/1/05)
Rhode Island
South Carolina
Texas

justifiable in my opinion... im sure he brought it up to her..( literally and metaphorically) lol.. that hes not happy with the almost non existent sex life.. but i guess there was no course given as to why it was that way.. and no option given to make it better... so he waited as long as he could until he gave in... im suprised he waited that long in the first place...

Good points 3 & 4. IMO cheating has little to do with a person's physical appearance. I have seen men cheat on their very attractive wive with a very UN attractive woman. Women don't put as much stock into a mans looks as men think they do. Sure they appreciate a good looking guy but there are many other factors that pave the road beyond just looks.
