By law, I believe the reason a porn actor is not considered a prostitute is because the actor is paid by the production company, not by the their partner.

Being paid to have sex, then having it filmed and made public, seems a lot worse than just a private, unfilmed deal between 2 people in the privacy of someone's bedroom.

I find it interesting from a public policy/legal standpoint that in Costa Rica, DR etc that prostitutuion is legal and not horribly frowned upon with the proviso that no third paty (i.e., pimp/madam) can profit from it.

And the working girls in CR are absolutely stunningly beautiful. Many are truly university students and work only until they enter into more accepted career paths.

The "Porn Industry" is actually a sub category of the legitimate film industry and as such is licensed, taxed and regulated accordingly. The government has decided that there will be NO licensing for prostitution and such any activities resulting in the payment for sex is deemed illegal.

In California at least, porn producers have been slapped with "pandering" charges for paying people to have sex. So there's that.

There are cases where the male "actor" pays a "producer" or a "producers agent" to have sex with a specific "actress", who is usually young and new to the business. These fees can often be in the thousands. By the letter of the law this would be pandering/prostitution and the producer or producers agent can be charged even if the act was filmed under the pretense of making a porn movie and the male actor is compensated (far less than the fee he paid up front).

It is legal in Canada, provided you don't have an 'agent' and you don't solicit in public.
