Married couple obtains business.Divorce.Then what!

Hello.
When I was married we obtained a business together.
No Lawyers or accountants. Just female honesty that you can rely upon.
Then Divorce.
Over $ 200000 taken out of line of credit. Dishonestly!
Supposed to be $15000.
Found out..the plane has hit the mountain.
For 8.5 years ex has been making $34000-$40000 every year from the business.
She works 7.5 months out of the year and maybe 18 hours per week.
I have not received a penny, though I had to pay half from the sale of the house to the line of credit.
Forgot to mention forged credit cards, but thats secondary.
Her lawyer is stating to me that the business is at a loss every year and I am lucky that the wonderful mother of the year doesnt get me to compensate for it!
My expensive Lawyer is just awful.I am being very honest, and i am not angry at the moment.
Your guess on my entitlement????
My Father owned a significant money making business..good for him.
I know if my Mother divorced him she'd be entitled to half. Weather or not she worked for him.
Am I missing something here?

Your posts make my head hurt.

What does the contract say that the two of you signed when "obtaining" this business?

If your expensive lawyer is so aweful, why do you still retain him?

How come the accountant for this business did not inform you of this "secret" line of credit?

The bank we dealt with for years, td canada trust in the mall whom I know almost everyone was never used in this transaction. Yes, I was suspicious! But we were married! I trusted her with my life!,
I have been looking for another atty. It is not easy!!!

Sounds like you are a good man. You need to find a serious B!TCH, female lawyer, preferably a lesbian. No, I am not kidding. It was the best decision I made when getting divorced. She wouldn't put up with the crap my ex and ex's lawyer tried to spew.

I think this train has not only left the station, it's in a whole 'nother State. You may be just too far behind the ball at this time to salvage anything other than debt.

+1. I'd have been shopping for new counsel months ago. You shouldn't be putting up with this nonsense. Get a good lawyer, rip her a new one (or agree upon how things are going to be divided) and get this behind you in 12-15 months tops. This is beyond idiotic.

These stories have been forwarded to my brother in law, who is a very financially and book smart guy...when choosing women he is a complete retard as his other head clearly doesn't possess a brain.

His father is worth millions, like lots of them, and he doesn't see that these scummy betches he brings home see nothing but dollar signs.

The family will be lucky if he doesn't screw up their entire trust with one of these entitlement laden low life broads...

OP, with such complicated personal, marital, and financial problems, what do you expect anyone here to be able to tell you, besides (1) "stop dicking around and get a good lawyer fer chrissakes" and (2) "aw poor guy we feel so bad for you"? These threads are all the same, just change the posting date and a couple details. Is this a group hug session or something?

Hi Mike,
This thread does tend to make the head hurt as SloDave says but what happened to the visitation rights with your son? Have you seen your son recently?

What you are going through must be really hard on your body. How do you stay sane? What joy do you have in life and what do you do for fun to take your mind off
all this? I don't see any resolution so changes are needed.

Time to hire a forensic accountant and request all of the business records.

Get someone to help you with punctuation and maybe we can help.

I'm certainly no legal expert in matters of divorce, etc., but I would suggest that you very carefully re-think your posting on this site...

You've posted "how to delete a Hotmail alias and all info" along with a divorce thread... This is the sort of thing that gets attorneys digging. Whatever happens next will cost you money. That I can guarantee.

Its not punctuation. Its fairly easy to read this guy's writing style/streams of consciousness, and conclude that he's a fairly seriously disturbed individual.

When I was married we obtained a business together. Where there shares issued or purchased? Who owns them?

Over $ 200000 taken out of line of credit. Dishonestly!
Supposed to be $15000.
Did she commit perjury? What did she do? Who's name is on the line of credit? Is it joint, or in her name?

For 8.5 years ex has been making $34000-$40000 every year from the business. Has she reported this income on her financial statement? If so, what is the issue?

She works 7.5 months out of the year and maybe 18 hours per week. Irrelevant. Unless your argument is that she should have a second job to increase her earnings.

I have not received a penny, though I had to pay half from the sale of the house to the line of credit. If the business was family property you should have had a business valuation done as of the separation date. How long have you been separated?

Forgot to mention forged credit cards, but thats secondary. That is a crime, call the police. It's not a divorce issue.

Her lawyer is stating to me that the business is at a loss every year and I am lucky that the wonderful mother of the year doesnt get me to compensate for it! What proof do you have to the contrary?

My expensive Lawyer is just awful.I am being very honest, and i am not angry at the moment. When you are done you will hate your ex, her lawyer and your lawyer. Success will be defined by whether or not you also hate yourself.

Your guess on my entitlement???? One half of the value of the joint property at the time of separation. Entitlement and 'what you get' are not the same thing.

My Father owned a significant money making business..good for him.
I know if my Mother divorced him she'd be entitled to half. Weather or not she worked for him.
Am I missing something here?
Context, rationality, commas, punctuation.

From a Pelican 'friend': You are not helping yourself posting here looking for legal advice to use in arguing with your lawyer. Get a lawyer you trust and deal with your divorce in a more private forum. Divorce sucks, you will lose. Keep your sanity not your money.

I feel for you however...

Don't know what you are looking for here....

One thing we all seem to agree on is:

1. Get a better lawyer

2. You are fooked

3. Perhaps this is sensitive info you should not be posting on the Internet?

Best of luck and carry on...

That is not necessarily true. We don't know enough facts. But it is quite possible he's fooked.
