let's be clear again...he will walk criminally unless there is a crazy in car video that none of us has seen.

there will be a civil case that will have real traction...it will however be settled out of court.

Or is this just what "due process" looks like?

I would not be too dismissive. I suspect there has been evidence that was more compelling than the youtube video...we just will not know until we know.

I still believe he walks criminally but the civil trial is real and it will ultimately be settled out of court.

still a sad situation.

just a quick comment..

I am here in my lake norman home and I had cigars w/ two of my friends from Penske. we discussed the situation and they were emphatic that this was over and there would be no case made criminally or civilly.

I was also emphatic and said...WRONG! this will not blow over and there will be a ripple effect regarding the team and sponsors. we will get to see this play out.

best,

pcb

Not what due process looks like, what political posturing looks like.

Criminal case-Not a chance

Civil case-Two chances, slim and none, and slim is not looking good. If it ever does end up in a civil case, a little thing called contributory negligence is going to keep the award from being more than a dollar.

Overly cynical. If just one man makes the decision, it would forever be labeled a coverup; if a jury of 12 does then the process was allowed to work. I think its entirely appropriate to allow a jury to evaluate the evidence before filing or failing to file charges.

Totally agree that K.J. Jr did contributed to his own demise but I'm willing to bet a Loonie, that whether by legal process or settlement out of court more than a dollar will be paid.

I think you nailed it.

If the DA on his own does anything someone will claim he was paid off. Few people believe a jury of 12 was paid off. No doubt many will still believe whatever verdict is delivered it was wrong.

There is a distinction between a grand jury who decides to indict (charge a person for a felony and a petit jury (trial jury to determine guilt ).

Grand juries in NY are secret juries containing 23 on the panel. 12 of the 23 must vote there is enough evidence to formally charge the person. Only the DA and the states witnesses appear to make their case for charging a person. The defendant and his lawyer are not allowed to appear.

Once formally charged the case goes forward and a petit jury hears the case at a trial. Must be unanimous verdict of the 12 to convict

Hence, it is a politically motivated decision.

you are correct. it will be done so out of court and at the "suggestion" of the france crime family. it will be a good bit more than a dollar.

As of this date, I fear that Stewart will be indicted, very soon.

Told you so.

They can't get past the fact that Tony hit the throttle.
