If he's really a law student, let the dean know what's going on. As unethical as some lawyers are, I thought they were supposed to be held to high ethical standards.

I have a few contacts with the law school community. I don't know if I could do anything but if you PM the school and his name I can see what I can dig up.

From the past experience that I have had with with some members of the this particular BAR, on personal business matters, NOT them representing me in a legal forum, but with personal sales, leases, rentals etc. I have learned not to trust the SOB's. I too have had to go through the court systems, just to be able to get summary judgments in my favor. All it did was cost me $$$$$, they know how to play the game of screwing you over better than anyone else, and they are usually VERY GOOD at it. The hardest hit I took, was from the sale of a corporation that I had started and nurtured into a fantastic money making machine. After a few years, I was ready to let it go its own way without me involved and placed it on the market. An attorney that I knew in Houston(I knew him from my LE times in the various court houses around the Houston area) bought the business. Everything was fine with the sale and proceeds... for 10 months. Then this assclown decided he just was not going to keep paying the remainder of the monies owed. After many, many months of all of the legal paper wrangling, writs, depos, court filed delays, extensions, etc. it finally went to trial. I was all over and done within three hours, and the judge issued a summary judgment, in my favor, and also was making application to the state bar, to have this *****s card pulled. The bottom dwelling scum-sucker had 14 days to appeal the judgment. He never did. This judgment was approaching the seven figure amount. The 16th day after the judgment was awarded, this SOB still came up with one more way to get out of paying. Supposedly, while riding in the elevator at the Harris County Court House in downtown Houston, the bastard dropped dead from a massive coronary. I was not living in Texas at the time, but I was notified within thirty minutes of this happening. I was on a plane from D.C. within two hours, heading to Houston, to the Harris County Medical Examiner and the Harris County Morgue. JUST TO BE SURE, that this was not another one of his tricks that he had done to get out of the debt. Much to my satisfaction, I attended the post, and it was in fact true. He was extremely, dead, for real. After his death, I still never got anything, because I was actually second in line with my judgment, right behind the IRS. The IRS did not get even close to what they had on him, so I was left sucking hind tit on this, because he had his estate so well protected, he didn't really own anything. everything he had, house, cars, paintings, collections, etc, were all either leased or rented. He had ZERO liquid or, on paper assets.

I know many fine people that are attorneys, but if you ever happen to get involved with one of the dishonest or shady ones, be very careful, they know exactly how to screw someone over to the fullest extent of the laws.

I hope things work out in your mothers ordeal, because it sounds like the guy is already on his way to becoming one of the ones that should not be trusted any further than you could throw your car.

In Virginia it's blue crab season - a couple of body parts in a few crab traps - and bingo - you have the neighbors over for a crab boil.

Nomatter what way you play it, this sounds like a situation that will end up in court. Might as well fix it now, even if it means being the defendant instead of the plaintiff. I'm not a fan of "rough" solutions, but this one might warrant one. Nothing worse than worrying about your mother's safety.

My mother is a teacher and lives alone. A few years ago she had trouble with a student following her home, pulling into the driveway at night, basically bullying her but never outright threatening her. She wouldn't tell me his name or let me get involved. Well, she went away one weekend and I stayed in the house to watch the dog, etc. He made the mistake of pulling up the driveway one night while I was there. I was out in the yard, and he didn't even see me or hear me coming. I got him right in the jaw, still sitting in the car with the window open, and kept at him as he backed out. Only time I've ever punched someone (other than my brother). I could have ended up in court, but I really think it would have be worth it. I don't think anyone would hold that against me.

The problem with most of these suggestions is that they are just fantasy solutions. This guy seems to thrive on litigation and there is no reason to believe if your mom just throws him out that he won't turn around and sue her. She will win in the end, but it will cost her money. The only practical solution I have seen here so far is to get a restraining order against him.

The only other practical solution is to just change the locks on the doors. While he could sue for an illegal eviction, the fact that he did a stop payment on the check is evidence that he breached the lease contract so his allegations would just be a wash. Make sure your mom has physical evidence of the stop payment.

Oh and I am one of those scum bag attorneys that no one has any used for.

Good advise, from my non-lawyer background.

Question for Kurt and others: since he deliberately did a stop payment on a check with apparently no good reason, wouldn't that make his written (I hope) rental agreement null and void? As such, wouldn't that mean that this fellow is now trespassing on austin552's Mom's property?

Also: austin - is there anything in the rental agreement that deals with failure to pay the rent? And failure to adhere to the conditions set forth in the rental agreement (out-of-bounds areas, food, phone charges...etc)

If this goes on his public record, I doubt that too many reputable law offices are going to want to hire him. Unless his aspirations are to be a sleazy two-bit lawyer. Perhaps a little reminder of this possibility would awaken him.

Also: wouldn't it be hilarious if austin was able to hire his father and brother to sue him? (A conflict of interest clause somewhere would probably prevent this, but one can imagine...)

I suspect that this law school student will have a rude awakening when he realizes that exploiting the law doesn't work for anyone - lawyers included.

If only it were that easy. Stop payment is no different than just not paying the rent. You are still bound by the landlord/tenant laws of the state which generally mean it will take 30-45 days to get the court to order him evicted. The laws tend to be in favor of the tenant. Most dead beat tenants are experts in the law.
