Also if the accident was 5 months ago why hasn't this minor property damage claim been resolved yet. They usually take a week or two

you got bigger problems than a pay out for your car.... 2 major accidents for your son. it is more than likely he is not a good responsible driver. or at least he has not been trained in defensive driving... if you accept the excuses that the other person was at fault you miss the reality of the situation.......... if I wanted to,I could find all kinds of occasions to let an accident happen that would of been the other persons fault.............

He said his son was rear ended. In the New York courts and in reality, 99% of the time that means the other person is at fault and there was probably nothing you could have done to avoid being rear ended

Your saying his son staged this accident?

I don't think he's saying the son staged them.

We used to do the voluntary defensive driving courses for the premium discount.

One particular course the instructor said he was going to play a video.

We were to count the number of potential hazards.

Average number counted by the class was 5 or so.

I counted 19.

There were 20 in the video.

My basic philosophy is nearly every accident is avoidable, even the rear ends can be avoided. Not all the time but you can increase your odds of avoiding one by paying attention.

I've got the red light ticket from one that I escaped. The ticket was cheap compared to the alternative. Had my kids in the back at the time.

Having spent years riding motorcycles and representing injured drivers, most of which stem from being hit in the rear, I too am always extremely cautious about watching behind and leaving an out etc.

For most drivers, whether they are as cautious as us or not, are simply not going to be able to avoid being the victim of a hit in rear collision when that time comes.

Even if you slam on the breaks and someone hits you from behind, the person that hits you is likely the last person who could have avoided that accident if they had left a safe distance between

Lots of interesting comments. ( based on conjecture)To the comment regarding my son being in 2 accidents, with him being at fault, and that maybe I'm at fault for believing he wasn't at fault...seriously?? The first accident a drunk crossed the center line on a 2 lane road with deep ditches on both sides, how do you avoid that? For this recent accident he was sitting in traffic at a stop and a 35 year old man on his freaking phone plowed into the rear of him , driving him sideway into the car in front of him.

I did find out that they will be settling for 3K on the car and they are nervous that we will sue for large amounts due to utter negligence to the dick head that hit him.

Agreed, the rear enders are the hardest to avoid.

That particular one was on a rainy day.

Coming up to an intersection and the light went yellow.

Guy in front of me and I start slowing for it.

I check my 6 as I always do and there's a guy in a lifted 4x4 barreling down on us.

It was obvious given the conditions and how fast he was closing he was not going to be able to stop so I leaned on the horn like a mother f'r and crawled up the guys ass in front of me forcing him to run the yellow.

We both pulled into the right lane on the other side of the intersection as the guy behind me blew by us doing a good 40-50.

Guy who I forced through understood right away and actually gave me a thumbs up.
