My brother the retired cop says you always have to start the conversation with the question "Are you a cop?" If she says no and she is that is entrapment.

Um, ya, in my former married life, I told some beautiful fibs (not infidelity related)! Houdini would have been proud. Oh the webs I spun...the master, I was! However, I never had my shizzle recorded by vice and/or cops. So I gotta give it to the guys who say old Carl is being less than truthful!

Not so.

It is perfectly legal for a cop to lie to you, and is NOT considered entrapment on it's own. For it to be entrapment, you have to have been persuaded to do something (illegal) that you wouldn't have done otherwise.
In other words, if you are simply provided with the opportunity to commit a crime, and not forced/compelled to do so, it is not entrapment.

In Carl's case, if he responded to an online ad, or agreed to a UC cop's advances, his intent would be pretty clear.
Either way, chances are he wouldn't have gotten clipped unless money was exchanged. So, as mentioned, he is/was completely FOS.

What a bunch of BS. The charges were dropped due to insufficient evidence. The recording made by the cops was unintelligable and they had nothing more to convict with. It cost this man thousands of dollars and nearly his marriage. The prosecution realized they had no case and pulled alot of shenanigans in order to strike a plea deal. Rescheduling the trial date four different times in order to wear him down and financially drain him.

My opinion of the prosecution was that they were more interested in maintaining a nice batting average of convictions versus actual justice.

I am satisfied with the outcome.

In the US you generally only have to get as far as discussing price and what you get for it. That will trigger the arrest. No money needs to change hands.

I heard a story the other day on NPR about a group in Seattle that were regular users of on-line services via a members only forum. They would discuss different Asian websites, girls met and services rendered and even meet to discuss same. They were all busted for "promoting prostitution". One committed suicide, some went to jail, broke up marriages, lost jobs, etc etc.

I can't remember where I read this, but there was a forum about prostitution in other countries. Some of these guys were discussing hookers in Iran and how much more exciting the sex was, knowing what the consequences of getting caught would be. That was insane!

A guy pulls up to a job site I'm at this morning. He's looking at a pile of old fencing stacked by the curb. I'm doing work next door. I notice right away he's got a cig in his mouth....and of course wind blowing my way.

He gets out and starts to ask about the pile. I immediately ask if he could please extinguish his cig....which he gladly does.

He tells me about when he goes out to eat and someone lights up if they don't put it out he'll take it away from them (because it ruins his meal).

I say...I don't have that problem...because I don't eat out.
