Taking the opportunity to drive home the idea of right and wrong, and the consequences of negligence.

The school and contractor knew better.
Following that logic if someone walked thru Central Park in the middle of the night and got mugged then the mugger should also be able to file a civil suit against the victim if he gets arrested?

if it were initials on my cement, even genitalia, i'd just laugh it off. really. if i caught them in the act, i might join them. it is harmless, really. it doesn't alter the strength of anything. at worst it is words.

then again, kill em all. just shoot em. if they are vandalizing by scraping their initials into wet cement, they have obviously earned death. kill em.

decide on your own which is in green.

I read some of the responses in this thread and know exactly why this country is a mess. Why is it always someone else's fault? It's no freaking wonder kids grow up taking no personal responsibility. The adults teach them to blame it on everyone else.

spray paint won't harm the strength or performance of your car

Who are you kidding, sir? We live in America. It's always someone else's fault. Isn't that somewhere in the Constitution?

Kids play a prank. Kids get caught. And now a dad doesn't want them to pay the (measly, IMO) price. Ridiculous. If the dad doesn't want to cough up $250, he should have taught his kids to not deface public property.

It was just a little misbehavior, but the penalty was also little, so pay it and teach your kids about consequences and respect and not getting caught.

Your right. They should just scratch 1" initials in you car. That would be the same.
Its ok as long as its not yours.

Fixed it for you.

For most people, a simple rule of thumb might be: "How would I feel about this if someone else was doing this to my property?" Under that light, even initials in a sidewalk would come out on the 'bad idea' side of the equation.

There are some who have a sense of entitlement which means this filter doesn't work.

Messing up other people's stuff is wrong. If you don't own it: it is other people's stuff and should be left alone.

Only if the mugger was injured by the victim.
Of course the victim should counter-sue, arguing that the mugger's injury was an occupational hazard for which the mugger was not properly insured.

So what is the injury to this girl that makes it ok for her father to file a civil suit?

Personally writing in wet cement is no big deal to me. Apparently the school feels it was bad enough to warrant it being repaired. Why should the financial burden be borne solely by the school/contractor?

She got caught, man up and pay up. Lesson learned, don't do it again or at least don't get caught.

It is interesting to try and correlate the responses to this question and other threads.

Here's what I think:

The sidewalk needs to be replaced. It has been vandalized by these three children, so the children (or their parents) should pay for the repairs.

In order to cause no further burdens, the parents/children should make arrangements with securing the necessary building permits, hiring a contractor, and overseeing the project.

Now, since the parents/children are investing in this new sidewalk, they have a right to design the sidewalk in such a way that is at least to the same standard as the orginal sidewalk was before it was vandalized.

Now of course, since the parents/children are paying for the new sidewalk, they have a right to 'customize' the sidewalk - including the carving of their initials in the wet cement before it dries.

Game, set, match: everybody wins.

Kind of shocking to me that, well, 3 kids caused $750 in "damage" by writing their initials in some wet cement. And how was the $250/ea arrived at? an estimate to repair? someones idea of a "good lesson"?

'Zactly. This did happen in New Jersey, so what did you expect? Logic? Fair results? Non-corrupt thinking?

It is your kinda thinking that keeps the folks who make cement boots in business, if ya know what I mean....
