My ex-wife parked in handicapped spaces all the time. She said it was OK because she's driving impaired. She was right of course.

I understand it's private property, but it also falls under the Charleston County Airport Authority police, in addition to the company security. Having access to the airport, runway and the military base, they both have arrest and ticketing powers for all types of illegal activities and parking, including handi-cap, permit only, etc. That's their right and I have no problem with it. Laws do require that handi-cap parking must be marked and the appropriate number met, whether on public property or accessed by the public.

Its the breaking of the law every day that chaps my azz and it's typical of the lowly grunts here and what they do.

Having caved in on this issue and others, it's another milestone of codleing to the nitwits who want a union here. The union wins without even being here. Makes me want to puke.

We have the same here. My 1991 BMW 318is gets 30mog, but isn't new enough to qualify.

what you and trkkoid seem to be missing is that the mall or other parking lot is private property

someone owns it - capiche?

I get it tho - you guys do not respect the rights of owners to manage their own property.

I don't believe parking in a MADE UP parking spot is in violation of any actual "LAW".
Can anyone show this to be different?

They'd like you to think it is.

The Handicap parking, I totally get that and have never taken their spot.

Decal reserved spaces we get aggressive about *except* the first week or two of the term, and during finals. Fine is $15, officers try and associate the vehicle registration with a student. If they can, a flag is placed on the student record and no grades or registration for next term or graduation if they have outstanding tickets. Ones they can't associate to a particular student get stuck in a database, repeat offenders get booted. The fines from decal parking and booting to into the "President's Scholarship Fund"
When I was in college, and tore up my knee, I was offered a handicapped parking by the security guard who saw my hobbling in on my crutches, and I turned him down, and recently, after my heart test, my doc told me to pick up the form since my test results, well sucked, but again, I said no.

Sorry, but I couldn't resist...

I'm with Byron,, I"ve had two knees replaced and a hip replaced 2x ,, I could have easily qualified for a handicap tag,, but never got one..
What chaps my ass is when people get them for being fat.. WTF ??? if they actually walked once in a while they wouldn't need a HC tag..
Oh but what I do regularly is park my SUV in a compact spot.. (it's a small SUV so I figure that qualifies)

Correct, IIRC. I added it in my reply that there is a broad spectrum of issues they cover.

The lot owner can have you towed. (if handicapped spot then the cops usually DO have Jd.)

But why not respect the rights of someone else?

Property rights are the most fundamental part of capitalism.

Where do you draw the line? Howabout SUVs in "compact" spots?

I do.

We're talking about goofy parking spots that are saying: "If you had a newer, better mileage, electric/hybrid car, you wouldn't have to walk so far"...

It's stupid.

I'm with Trekkor on this one.

Does my SUV with active fuel management count as a high efficiency vehicle? What about a new Corvette for that matter?
The grocery store near us has parking for mothers with child and expectant mothers. What time frame qualifies as an expectant mother?

I usually park far away from other cars anyways. I can handle the walk and prefer not to get door dings etc.*

Disclaimer: I only take up one spot and park within the lines.

Some reading for y'all.

http://ag.ca.gov/cms_attachments/opinions/pdfs/o516_07-804.pdf

http://sf-police.org/Modules/ShowDocument.aspx?documentid=14593

V.C. Section 22953 - Removal Prohibited

My tentative conclusion for California is that in a privately owned parking lot (which is pretty much all we ever park in, think grocery store, mall, office building, etc - all private property), you can be towed for parking against posted rules, even if the rules are stupid. However, you have a one hour grace period, unless it is a disabled spot, fire lane, or fire hydrant, or an residential building's parking, or a motel parking space designated for a specific room. The parking lot owner has no right to impose a fine ("ticket") or put a boot on your car. Having your car towed and having to pay the towing fee and impound charges is the only permitted sanction.

However, the situation varies by state. In New York, you can be booted. In Washington, you can get a ticket which can then go to collection and credit reporting.

If I am correct - IF! - then in theory, in California, you can park across three spaces, in a pregnant ladies parking spot, or in an electric car charging spot, or in a Porsche-only spot, for 59 minutes and 59 seconds, and no one can say boo.

In practice, of course, you'll be taking a taxi to a tow yard and fruitlessly playing jailhouse lawyer to a bored guy who's not giving back your car without tow and impound fees paid first.

O.k., all you property/parking "rights" advocates, how about if the "good" spots were labeled as "whites only"? Would that be o.k.? Enforceable? Property owners can do as they like, right?

Wish I could have filmed this.

Tonight I stopped at the local Albertsons. Parking lot was almost totally empty and I got the second spot closest to the door. As we're walking in, a CTS full of four drunk kids pulls into a handicapped spot behind me and totally trashes the front spoiler on the curb. The noise was just awful and then again as the drunk driver backed up. I'm sure it was one of their parents' cars and it will be noticed. I hope the cops got them too.

No, Jeff. As you surely know Congress outlawed discrimination.

I like the way all the right wing people ignore property rights!

They only outlawed discrimination against a few classes, not all discrimination. Currently it's race, religion, nat. origin, sexual orientation, gender, handicap, etc. and one or two I'm probably forgetting. They're always looking to add to the protected classes. It's perfectly legal to put up a sign for "non-lawyer parking only" and it's not discriminatory in the least. In fact, there was even a lawsuit in CA years ago where a builder figured it'd be too much hassle to sell to a lawyer, so he refused. Lawyer, of course sued, thereby validating the builder's reason for not selling to him. Builder won because, even in CA, it's not (yet) illegal to discriminate against lawyers.

Saw a weird one yesterday...2 handicaps fighting over the single HC spot w/ the spot next to open as well. 2 old farts having a discussion in lanes as others backed up behind them. But...this is Kalifornia's entitlement mentality.

Truth be told, I could care less about those signs. What I hate more are door dings. Until they start putting handicap or hybrid parking spaces on the end caps out in the north 40. Its absolutely no problem for me. I'd rather walk a little further then risk a door ding.
