Did you ask to see his radar readout? Did you ask to see the last recorded calibration? Play it smooth, with respect, don't argue but DO show preparation and accept with fairness. If the cop doesn't allow you or is having a rough day, time in court will decide your fate.

it was over 103 degrees when this happened and I saw how defensive he got when I questioned the 96, it was worthless to try some BS "I know the law" conversation.
I'll fight it and either I'll get a judge in a good mood and get traffic school or I wont and will have to deal with insurance. Pure crap but that's the way it is with law inforcement

You are lucky it was not in NC. 80 and above is a class 2 misdemeanor with possible jail time and license suspension. 15 over in a 55 mph or higher zone is considered reckless driving. $400 plus court fees and license suspension.

actually Lee I just did last week because of the cruise control. It was within 1 mph which makes sense since I have stock wheels and tires.

Amazon.com: Fight Your Ticket & Win in California eBook: David, Attorney Brown: Books is a good resource. You could start there, then decide if you need an attorney.

No surprise there since very few tickets are written in positive ions.
Can you say with a straight face that you haven't had a speeding ticket in negative ions? I think not!

90 mph is not "cruising", in my book.

True, generally speaking, but my wife and I, in a used Ford V8, 2door hardtop slushbox, driving cross country from Ohio to southern California for the first time, cruised for hours on end, for two days at 100 mph, through many of the desert states.
And, this was when very few miles had completed sections of nterstate freeways. Been over all of Route 66 ...never once, in subsequent trips, getting tagged in the notorious speed trap just outside Tucumcari. Oh yeah, that first trip was in mid summer and the Ford had no AC! All windows rolled down, all the way. Good times! ![]()

The cop is daring you to play the game, and you need to decide if the game is worth it to you, financially, and time-wise.
He's betting it's not worth it for you, and he's probably right. PS to be honest, if you were doing 88-90 in a 65 . . . . .. . . . well . . . . . . . .

Just wondering, what is the posted limit there? It blows my mind how fast many do drive there in California , even in heavy traffic with no enforcement happening.
Sounds like your guy was wound up a bit. |

I'm not even 'old' and I learned a while back... I just do the speed limit, or slightly above to keep up with traffic. That's it.
I freak out at friends for driving fast. Why? I mean, I love to race around and wring out a car, but on the highway... it all goes the same place. if I get there 30 minutes later... so what. Now flat out speeding just the be speeding... that's what the Agusta is for. It sees your 96 and raises you 60...

I think the low speed limits are downright stupid. Modern cars/roads would handle much higher speeds than 50-55 Mph which is what most are where I live. I could easily drive safely on these roads closer to 90-95 which is what I do to pass quickly.
I usually drive between 10-13 above the limit on the highway unless it means that I have to pass a LEO to do so. Since I go to work early and come home late in a mostly rural area, the traffic is usually very light and there are no kids, pets, etc out and about. Going faster is just not worth the risk if a ticket, increased insurance expense, etc. Strangely enough, most tickets I have received (none recently) have either been for much higher speed than I was actually going...it I was totally innocent. Maybe karma for all the times they did not catch me...but worrisome nonetheless. In the rural county that I have lived in the past couple if years, the Sheriff's dept is small with a small budget and don't seem particularly interested in enforcing the speed limit (as it should be and why my local taxes are very low). i have yet to see a Sheriff's dept radar trap driving the length if the county each day and back. The only problem is that now and then there is a State Police speed trap now and then in more travelled areas. Good luck on this. |

My wife got a ticket here in NC about 2 months ago. 55 zone and he hit her for 76. We hired a lawyer, he went to court and made a deal. Cost us around $350 for the lawyer and another $200 for the ticket. Seems like a racket, lawyer knows the judge, they plea them all down to reduce workload in traffic court. The state gets the $200 bucks plus court costs, the lawyer gets his fee and the judge keeps his/her court room cleared out.

I picked up on a speeding ticket in NC years ago and had to go before a court magistrate before they would let me go. Had I been going a little faster I was told the car would have been confiscated. It was a rental car and I was on a business trip. Try to put that on the expense account.

I got a ticket for 26 over. When I realized what he wrote the ticket for I asked if he could lower it to 24 over so I could take DD. That really set him off and he said he knew I was going well over 100 and if he had clocked me for that I'd be in the back of police car right now.
I went to court and asked the prosecutor if I could still take defensive driving. He pulled my driving record and after a brief discussion about a couple of issues he agreed to let me take it. This was 25 years ago and things have certainly changed but it's worth a try.
