So the pickup truck driver has been rude to the insurance reps, eh? This should definitely help your cause. Obviously you can't say this about all big truck drivers, but in my experience they have been among the most obnoxious, aggressive drivers on the road. It's Freshman year psychology when you get down to it, simple alpha-dog behavior: there are certain types of men who always want to feel like the biggest, strongest dog on the block. This also goes for while they were in traffic. There was a time when you would have made this argument about Porsche/Corvette owners, but the truck owner has taken this mantle, IMHO. And I mean this in general; of course there are completely reasonable truck drivers out there.

Cop's shift was probably over in a half hour. Either that or there was a 2-for-1 donut special up the road he didn't want to miss.

That was blatant assault with a deadly weapon and the guy should have been arrested on the spot. I'd have raised holy hell with the cops right then and there. I don't think you made your case very strongly or clearly. I'd have DEMANDED that they arrest the guy or at least investigate.

FWIW, I was rear ended twice in three mos. in my 330i. The last time was Aug. 24th, when a German au pair hit me so hard I thought the change in my backpack was gonna break my windshield when it flew out like buckshot. She was clearly at fault and the cop said so himself. HOWEVER, when he came over to talk to me about insur. and paperwork, he said he didn't know what he could charge her with!!!!! I said, "How about failure to maintain control of her vehicle?" He agreed, but said it was worthless because she was going back to Germany forever four days later, would not pay the fine, would not show in court and her US license wouldn't matter anymore, since she had a German one too. He also said that her not getting a ticket would not affect her at-fault status and her insurance would be responsible. And State Farm has agreed to pay for everything and is even working on my diminished value claim now.

When I was younger I did a lot of speeding and wasn't smart about it. I guess it's possible that it was more like 12-16 times, but at this point, who knows.

I was going down A66 from Wiesbaden and had a car fly past me on the right while I was in the lane merging onto A5. Dude was flipping me off (which is a big no-no) and swerved in front of me causing me to either slam on my brakes or hit him. All while we were doing about 130KPH. I managed to keep the car straight but a couple of cars behind me hit the dirt.
As I got down the road a little closer to the frankfort airport I found myself catching up with the car and the dude started swerving in front of me, and onetime nearly caused me to get into the center barrier. If you have driven near the Frankfort airport you know what I am talking about. The last time he did this I slammed on my brakes, as did three other cars and he made his getaway.
Oh yeah, did I mention that this was at 1700 and traffic was pretty thick. I had however whipped out the camera and taken pictures of his license plate and him and when i got home I went to the polizei and reported it. They looked at the pictures of the kid and laughed
"oh yeah, young turk" (They do not necessarily like turks here) and said the would take care of it.

I was driving right around there about 10 yrs. ago in my beater Peugot rental at about 4:00am. I wanted to pass the guy in front of me, was doing about 150 km/hr, checked my mirrors, put my signal on and pulled left. I could see two tiny headlights way behind me at the horizon. By the time I got in the left lane and was completing my pass, a 993tt was on my bumper. He had to be doing close to 300 km/hr when I saw him on the horizon. Unreal. I got over and he pulled away like I was standing still. Oh, I miss driving there.

About six months later I get a letter from the Darmstadt Polizei office explainng what happened in the investigation. They called the other people from tracing down their license plates and got witness statements from them. The tracked the license plate of the young turks car and found that it was registered somewhere else and then calmly waited for the guy to show up to arrest him. While this was going on the held a trial in "absentia" and found the young turk guilty of an a$$load of things. When they found him they sent him to the Darmstadt jail for eight months and revoked his license for 10 years. They take driving and safety very seriously here. It cost a LOT of money to get your drivers license and it is too easy to lose it.
The Germans do not take to ********* drivers when people are driving 210kph. Hope everything works out for you in your dealing with Bubba.

Pity they don't take driving seriously in the states. If they actually TRAINED drivers, then TESTED them, we would have far safer roads. Amazing that we have so much bureaucracy for driving, but they do so little.

Absolutely! You should have immediately asked for the LEO's supervisor and escalated it on the spot. I don't know about nationwide, but here in NC, they are encouraging drivers to dial "*HP" to report drunks, reckless driving, excessive speeding, etc. I realize hindsight is 20-20, but if you had simply dialed *HP when he began the agressive tailgating (that in itself constitutes ADW), you would have at least had "some record" of the event. Another idea, if you have a camera phone, attempt to snap a pic of them riding on your a$$.
I've had the same thing happen to me (albeit not an accident) for passing a pickup, so I've had time to mull it over since then...

Yes, ensuring that drivers are proficient and responsible would save many lives and a huge pot of tax money, but we can't do that here. It would reduce car and gasoline sales.

Motoring bureaucracy here is less than there. Auto parts, for example. In Germany, they all most be tested and approved. Here, you can probably buy wheels for $25.

Yea, that's the answer. More government oversight.

They'd just end up getting paid off anyhow.

Sometimes a little more government oversight is not a bad thing. You have to take lessons at the driving school here and it cost's thousands of dollars before you can get behind the wheel of a car, plus they do not let you loose when you turn 16.
Anyone who has driven here will tell you that they feel mush safer driving here at 120mph versus driving back home at 60. The incident like I expalinned above is definitely one of the ntimes I would not mind a bit more involvement by the gub'ment. Plus cops here take that c#$p seriosly unlike at home.
keep in mind that you can still get speeding tickets here but it is generally the ********* dangerous drivers that the cops go after, not the haulin a$$ "safe" driver.

Too bad it's not like that here and never will be. Our driving laws and culture cater to the lowest common denominator. Cops here only care about fine revenue and almost never for safety issues. Today I got on the HOV on-ramp and there were three state troopers there looking for HOV violators. Nevermind the idiot that had just made a right turn in front of me from the left lane and with no turn signal. Nevermind the IDIOTS on cell phones, putting on makeup, reading the newspaper, doing anything EXCEPT paying attention to the road. Unreal.

Road rage is a crime. Hitting someone on purpose is aggravated assault. Seems like if there's evidence that he hit you twice, as you've stated, then that's enough evidence to back up your story and get him locked up.

Witnesses would be nice, but if there are two different dents/dings, then your car is the witness.

Contact doesn't even have to be made for ADW (assault with a deadly weapon). If you're on a m/c (for example) and someone is on your a$$, it's as if they're pointing a gun at you...

why is it *********s not only want to follow a p-car.............but they want to follow nascar drafting???? WTF? is it about these cars that make idiots want to do this????

i know when i see any sport car/racey car i never get a desire to ride their A$$. but every damn time i take mine out on highway or city for say a half day or even a full day, someones gotta ride my A$$!

hope ya got to give him a nice GRIN while in court!
