I checked with our longest serving FFL in San Diego and he said "To ship a firearm that shoots a CARTRIDGE or can be made into a gun that does, across state lines, it has to end up at a FFL, even if it/they are to yourself at a new address. He noted that this is federal law which trumps state law. Muzzle loaders including new "Italian" copies are exempt, even to California as the federal government does not consider them as weapons! As you are doing now, check the real references not someone's advice.
As I noted earlier, I would get TSA approved cases, which can always be sold later and use them. If you pull the rifles apart that can and probably will cause questions if inspected or the packages are x ray'd or searched or..... |

Best way to move spoons cross country?
Could you ship lower receivers in one box / shipment and the rest / uppers as part of another separate shipment? Just wondering. I know people buy / sell components online all the time but have no idea about what needs / doesn't need to go through an FFL. I thought you could possess the lower receiver and the upper at the same time for a particular firearm only if it is legal in a particular state and you have any applicable federal permits (e.g. Class III for a full-auto, etc.)
I don't see why I need a law degree to understand how to legally procure / transport / keep a firearm. It's insane. There has to be a reasonably simple way to deal with this (like "just go through a FFL" as a suggestion, but I'd love to hear some others - preferably ones that are inexpensive and don't leave paper trails around). It's nuts when a constitutionally-guaranteed right has gotten so twisted that you pretty much need to assume that anything you ever want to do with a firearm is somehow illegal and runs afoul of one or more local, state or federal laws, with varying degrees of obscurity.

As to the question of just the receivers, if that is the part with the serial number, I.E. an AR-15 commercial one and NOT an 80% one you made yourself then if is the same as a fire arm. A FFL has to be used to get it when crossing state lines. YOU can ship it and when I sold the AR-15's and other rifles before using muzzle loaders exclusively then the person on the other end has to have a valid FFL license. There has to be a copy of it with the package also!
As far as barrels, sights, mags, stocks, etc then they are no big deal as they do not constitute a fire arm in the eyes of BATF/E. If these are 80% lowers you machined and assembled yourself then you have to accompany them on your journey. They can NOT be shipped or sold according to my FFL and Don has doing this a long time. |
